Effective counterterrorism measures and laws are enhanced by various elements including effective controling of high risk materials which could be used for s terrorist attack. There are various potentially hazardous high risk materials that could be weaponized by malicious terrorist groups and individuals. It is well known that some high risk materials, such as high risk chemical materials and radioactive materials, could cause uncountable damage to our societies in a deadly way. Therefore, investigating and developing measures and polices specially focused on security enhancement for the high-risk materials could contribute to the security of our society. Thus far, there are still lack of attentions to this subject matter in South Korean society. For example, The existing Terrorism Prevention, rectified in 2016, is still not enough and criticized for its loopholes for the control of high risk chemical materials which are potentially used for terrorists’ attack. Responding to this necessity, this study investigates domestic counterterrorism polices, laws, and practices in terms of controling high risk chemical materials. Especially. this study focused on the domestic laws and practices managing high risk chemical materials to propose counterterrorism laws and measures that could reduced the risk of certain hazardous chemicals which is potentially used for terrorists’ use. Such legal and policy suggestions are also discussed.

일반적으로 테러위협에 대한 대응역량강화는 첫째, 테러위험인물에 대한 탐지와 감시, 둘째, 잠재 적 테러공격대상에 대한 보안강화, 셋째, 테러공격발생시 위기대응역량 구축 및 강화, 그리고 넷째, 테러이용수단에 대한 관리개선방안 모색 및 강화 등을 포함한다. 이와 같은 4가지 측면들은 테러대 응역량강화를 완성시키는 4개의 축이 된다. 국내 테러이용수단 관리개선방안에 대해 모색해보는 것 은 테러대응역량 강화를 위한 주요한 한 축을 발전시키고 완성해나간다는 측면에서 주요한 의미가 있다. 이 논문에서는 특히 테러이용수단 가운데 화학물질 관리개선방안에 주목한다. 테러대응역량 강화를 위해 국내 테러이용수단에 대한 법제나 관리 실태에 대해 파악하고 문제점을 개선할 것을 제안하는 연구를 수행하는 것은 주요한 의미가 있다. 테러이용수단관리의 중요성은 이미 지난 2016 년 제정된 ｢테러방지법｣에도 반영되어 있다. 동법에 따라 관계기관의 테러이용수단에 대한 안전관리 대책 수립 의무가 규정되고 시행령에서 세부내용이 정해졌다. 그러나 테러이용수단으로서의 화생방 물질과 관련된 규정은 더욱 개선 발전할 필요가 있다. 이는 여전히 테러이용수단으로서의 화학물질 의 효과적 관리를 위한 만족할만한 법적규정이나 지침이 미흡하며 따라서 관리에도 빈틈이 발생하 고 있기 때문이다. 예를 들면 테러이용수단인 화학물질을 관리가 관련 부처의 개별 법률에 의해 이 루어지고 있으나 이와 같은 화학물질관리의 입법취지가 안전관리 중심이어서, 테러 예방 및 대응활 동에 적용하기에는 한계가 있다. 이에 따라 이 연구는 국내의 테러이용수단관련 법률과 관리 실태를 살펴보고 이를 바탕으로 화학물질 관리와 관련한 문제점을 파악하고 개선점을 제안하고자 하였다. 특히 이 연구는 테러이용수단으로 화학물질을 규정하는 현행법률 및 관리 실태의 파악에 초점을 맞 추고 이를 바탕으로 법률적 정책적 대안을 제시하고자 하였다.
