Spain is characterized as a Regionalized Country which means being composed of 17 Autonomous regional territories of ‘Comunidad Autonoma’ and they possess a various and extended decentralization powers guaranted by Spain Constitution. Therefore, for their local police and municipal police organization, major Regional Governments such as Catalunia, Navarra, Basque already are endowed with autonomous powers on organizing Regional government’s local police and the municipal police by every municipality within their territory. Our paper explored Spain’s speciality in its local and municipal police systems and got the lessons from the result findings.

스페인(1986년 경찰조직법)은 자치경찰에 관한 일반법인 자치경찰(조직)법을 이 미 오래 전에 제정하였고, 이를 근거로 각 지방정부는 자치경찰에 관한 자치법규를 제정하도록 함으로써 지역정부 중심으로 자치경찰제를 설치·운영하고 있다. 특히, 스 페인은 자치경찰에 관한 근거를 헌법에 명시한 것은 오래된 지방의 전통을 배려한 것 이었으며, 1986년 국가경찰과 자치경찰의 조직, 기능, 지휘체계 및 상호간 관계를 명 확히 규정하고자 경찰조직법도 제정하였다. 또 주민 5천명 이상인 기초정부는 자치법 규를 제정하여 자치경찰을 설치할 수 있도록 하여 주민의 평화와 각 개인의 생명과 재산을 보호하는 1차적 의무를 담당하는 기초정부의 최고책임자로써 시장의 지휘하에 기초정부의 자치경찰 활동을 할 수 있는 자치권을 보장하고 있다.
