Since election reporting by the press is the core freedom of political expression among every freedom of expression, the constitutional request is that laws regulating this shall provide the concept of expression subject to regulation specifically and clearly. However, in the case of the fairness review of election reporting, there is a limit in presenting the specific and clear review criteria due to the openness of fairness which is its review criterion. Therefore, it is required to establishing the core requirements to secure the fairness of election reporting and then to make them concrete as a regulation for review, whose necessary requirements have been presented in the existing paper of the author as follows: ① factuality, ② diversity, ③ balance, and ④ neutrality. This thesis aims to analyze the general deliberation criteria in the Directive of the Internet Election News Deliberation Commission which is a practical criterion for the deliberation of election reporting prepared by the Internet Election News Deliberation Commission based on the four necessary requirements for the fairness of election reporting described above. Moreover, an introductory improvement plan for the general deliberation criteria in the Directive of the Internet Election News Deliberation Commission is suggested in the order of fairness review by reflecting the structural characteristics of fairness notion in the analysis results of the general deliberation criteria. It is hoped that fairness is judged on the basis of clearer deliberation criteria in case of the fairness review of election reporting by internet media in the future based on this suggestion, the deliberation system, where the free market of thought has an ancillary role for normal operation, is faithful to its proper role without diminishing freedom of expression, and the freedom of political expression is ultimately guaranteed.

언론사의 선거보도는 표현의 자유 중에서도 핵심적인 정치적 표현의 자유이므로 이를 규제하는 법률은 규제 대상이 되는 표현의 개념을 구체적이고 명확하게 규정해야 하는 것이 헌법적 요청이다. 그런데 선거보도의 공정성을 심사하는 경우 그 심사기준인 공정성의 개방성으로 인해 구체적이고 명확한 심사기준을 제시하는 데 한계가 있다. 따라서 선거보도의 공정성을 확보하기 위한 핵심적 요건을 정립한 후 이를 심사규정으로서 구체화하는 작업이 요청되는데, 필자의 종래 논문에서, 그 필요적 요건으로서 ①사실성, ②다양성, ③균형성, ④중립성을 제시하였다. 본 논문에서는 위의 선거보도 공정성의 네 가지 필요적 요건을 바탕으로, 인터넷선거보도심의위원회의 선거보도 심의의 실질적 기준인 「인터넷선거보도 심의기준 등에 관한 규정」 중 일반 심의기준을 분석한다. 그리고 일반 심의기준 분석 결과에 선거보도 공정성 개념의 구조적 특성을 반영하여, 공정성 심사순서대로 「인터넷선거보도 심의기준 등에 관한 규정」 중 일반 심의기준에 대한 개선 안(案)을 시론(始論)적으로 제시한다. 이러한 제안을 토대로 향후 인터넷언론사의 선거보도에 대한 공정성 심의 시 보다 명확한 심사 기준을 근거로 공정성 여부를 판단하여, 표현의 자유를 위축시키지 않고도 사상의 자유시장의 정상 작동을 위한 보조적 역할이라는 심의제도의 본연의 역할에 충실하여 궁극적으로 정치적 표현의 자유가 보장되길 바란다.
