If the insolvency procedure, a comprehensive and collective proceeding, is carried out, there will be a collision with the litigation and enforcement procedure, that is an individual proceeding, in legal practice. Especially, Debtor Rehabilitation and Bankruptcy Act is giving the insolvency procedure priority to the litigation and enforcement procedure. Accordingly, the Declaration of Bankruptcy makes the property of a debtor consist of the Bankruptcy Foundation and gives management disposal rights for the property of a debtor to a bankruptcy trustee. As a result, the litigation on the foundation of bankruptcy is suspended and a bankruptcy trustee takes over it. Moreover, the effect of the compulsory execution for the property that belongs to the bankruptcy foundation is lost. Regarding the interrelationship in which the two different procedures collide, namely the effect of the Insolvency Procedure on the Litigation and Enforcement Procedure, this research paper deals with a stage of the application for bankruptcy, a stage of the declaration of bankruptcy and a stage of the termination of bankruptcy, step by step specifically and in detail.

파산선고 당시 채무자의 모든 재산을 대상으로 한 포괄적⦁집단적 절 차인 파산절차가 진행되면 법률 실무상 채무자의 개별 재산을 대상으로 한 개별적 절차인 소송절차 및 집행절차와 충돌이 발생한다. 특히 ‘채무 자 회생 및 파산에 관한 법률’은 파산절차를 소송절차보다 우선하게 하 여 파산선고가 있으면 채무자의 재산은 파산재단을 구성하고 그 관리처 분권을 파산관재인에게 귀속시켜 파산재단에 관한 소송이 중단되고 파 산관재인이 이를 수계하도록 하고 있다. 또한 파산재단에 속한 재산에 대한 강제집행 등의 효력을 상실하게 하고 있다. 이 논문은 위와 같이 상호 충돌하는 두 절차 사이의 상호관계, 즉 우 선적 효력을 가지고 있는 파산절차가 소송절차 및 집행절차에 미치는 영향과 관련하여, ① 파산신청단계 ② 파산선고단계 ③ 파산종결단계에 이르기까지 각 단계별로 구체적이고 상세하게 살펴보고자 한다.
