Recently there are unfair practices in Korean public service projects performance. They are divided on unreasonable alternation of service task instructions, breach of contract price adjustment condition, unilateral project suspension by ordering organization, etc. This study has been reviewing with government unfair project performance practices in Public Engineering Service Contracts. As a means of enhancing fairness of Public Engineering Service Contracts, we propose an alternative General Conditions in Public Engineering Service Contract. This Proposal is based on FIDIC Client/Consultant Model Services Agreement (White Book), and General Conditions of Korean Public IT Project Contracts. 7) I wish this research would contribute global competitiveness improvement of Korean Public Engineering Business in many ways.

최근 정부의 사회간접자본 투자사업 및 공공기관 투자 감소로 엔지니어링 시장이 장 기적으로 침체되어 있고 더불어 엔지니어링 업체들의 경영 애로 및 기술자 대우가 열악 해지는 현상이 빚어지고 있다. 특히 침체된 시장에 있어 불합리한 엔지니어링 사업대가 산정, 가격위주 사업자선정, 계약이후 불합리한 요구 등 엔지니어링 제도 및 관례로 통용 되고 있어 국내 엔지니어링 산업의 자생적인 경쟁력을 저해하는 요인으로 작용하고 있 다. 이에, 계약금액 조정 등 계약이행 단계에서 계약법령 및 관련규정 등에 따른 불합리 한 제도와 불공정 관행을 개선하기 위한 제도적 장치를 마련할 구체적 방안에 대해 검토 가 필요하다.
