The Optional Protocol to the Convention on the Rights of the Child on a Communications Procedure (OP3-CRC) is an international human rights treaty that allows children, groups of children or their representatives, who claim that their rights have been violated by their State to bring a communication, or complaint, before the UN Committee on the Rights of the Child. It may be a quasi-judicial mechanism. The OP3-CRC doesn’t create new rights, it just guarantees a better implementation of the existing ones. All states ratified the CRC, therefore, are committed to respect, protect and fulfill all children’s right that provided in the Convention on the Rights of the Child(CRC). In this paper, the second chapter gives a general overview of the CRC and its three Optional Protocols. And the third chapter surveys cases that the UN Committee on the Rights of the Child adopted their ‘Views’ in 16 cases. The Committee think the best interests of the child principle is the most important thing in all cases and the right to express child's opinion, too.

우리나라는 유엔 아동권리협약과 제1선택의정서 및 제2선택의정서를 비준하였다. 그러나 아동의 권리에 대한 국내적 구제가 미비한 경우에 직접 유엔 아동권리위원회에 제소할 수 있는 개인청원제도를 근간으로 하는 제3선택의정서의 가입은 미루고 있는 실정이다. 이러한 상황에서 제3선택의정서를 비준할 경우에 발생할 수 있는 문제를 살펴보는 것은 매우 의미가 있다고 생각한다. 그래서 이 글은 유엔 아동권리협약과 동 선택의정서를 개관하고, 그동안 개인청원이 제기된 사건 중에 유엔 아동권리위원회가 견해를 채택한 16건의 사건에서 어떠한 점들이 문제가 되어 개인청원이 제기될 수 있는지 살펴보며, 제3선택의정서 비준시에 국내에서 발생할 수 있는 문제들을 청원사건들에서 추출된 문제점들과 관련하여 살펴보았다. 아울러 그 사건들에서 특징적으로 제시되고 있는 유엔 아동권리위원회의 견해로부터 우리나라에서도 동일한 문제가 향후 발생할 수 있고, 그 문제에 관해 유엔 아동권리위원회가 여러 가지 내용을 권고하였을 경우에 발생할 수 있는 국내적 문제를 추론해 보았다.
