The use of drones is expected to continue to expand regardless of the public and private sectors, and with the development of technology accordingly, it may show a pattern beyond the currently foreseeable range. In the case of regulatory legislation on this, the feasibility of enforcement and the limiting range of basic rights restrictions should be considered, and legislative improvements should be harmoniously made to predict and prevent an increase in risk for relatively technological development. In the case of preventive legislation on the dangers associated with the increasing use of private sector non-business drones, it is necessary to be wary of excessive infringement of basic rights, but at this point in time, the side effects of drone safety accidents and criminal abuse cannot be ignored. Realization of more aggressive preventive policies is required. Accordingly, this study examined the issues of current regulatory legislation according to the dangers of crime and safety accidents caused by drones, and focused on legislative discussions to prevent and respond to drone crimes, invasion of privacy and safety accidents. In short, it can be said that proactive regulatory and enforcement legislation is necessary to prevent possible risks in the case of the use of private drones for non-business purposes, and legislation should be improved. In addition, legislation is required to achieve the proportionality and appropriateness of regulations for the use of non-business drones in the private sector, and the effectiveness of the regulations.

드론 산업의 성장과 민간부문에서의 비사업용 드론 활용은 계속해서 증가할 것이며, 그 활용 범위는 점차 확대될 것으로 예상된다. 이러한 드론 활용에 따른 순기능을 극대 화하기 위한 정책 이면에는 드론에 의한 안전사고 및 범죄 악용에 대한 사전예방 작용 이 선행되어야 한다. 민간부문 비사업용 드론 활용 증대에 따른 위험 예방적 입법의 경우 과도한 기본권 침해를 경계하여야 하지만, 드론에 의한 안전사고와 범죄 악용에 따른 부작용을 도외시 할 수 없는 현 시점에서 보다 적극적인 사전 예방적 정책의 실현이 요구된다. 이에 따라 본 연구는 드론에 의한 안전사고와 범죄위험성에 따른 현행 규제입법 상 쟁점을 살펴보고, 드론 범죄 및 사생활 침해와 안전사고를 예방하고 대응하기 위한 입 법론적 논의를 중심으로 전개되었다. 요컨대, 비사업용 민간 드론 사용의 경우 야기될 수 있는 위험 예방을 위한 실효적 인 정책 입안이 지속적으로 이루어져야 하며, 드론 기술의 발달과 이를 규제하기 위한 입법개선 간의 합치가 이루어질 필요가 있다. 이와 더불어 민간부문에서의 비사업용 드 론 사용에 대한 규제의 비례성과 방법의 적절성, 그리고 규제의 실효성을 달성하기 위한 입법이 요구된다.
