Police officers who have received reports of seriously dangerous behaviors of mentally disabled people arrive at the scene and take initial action, and it is difficult to respond because they are mentally disabled and generally family members. The purpose of this study is to improve the human rights and therapeutic opportunities of the mentally impaired in this situation, and to suggest countermeasures that can minimize the damage caused by the risky behavior of the mentally impaired. In this study, First, the incidence of mental disorders, the current status of crimes for people with mental disorders, the trend of increasing and decreasing, and the fear of crime were discussed. Second, the situation of the criminal behavior of the mentally disabled and the police's initial investigational response were tracked through the media-reports about the case that the damage was serious among the criminal behaviors of the mentally disabled. Finally, among the contents of the revised( May 30, 2016.) “Mental Health Welfare Act”, various hospitalization requirements and procedures were reviewed to strengthen the human rights of people with mental disorders. In order to give a therapeutic opportunity without deteriorating the risky behavior of the mentally impaired person, Initial measures of police should be done by the integrated system that connects police / family / neighboring residents / local government / medical professionals / hospitals, etc.

정신장애인의 심각한 위험행동의 신고를 받은 경찰관들은 현 장에 도착해 초동조치를 하는 바, 사건 당사자들이 정신장애인이 고 일반적으로 가족들이기 때문에 그 대응이 어렵다. 본 연구의 목적은 이러한 상황에서 정신장애인의 인권 및 치료적 기회를 제고하고 정신장애인의 위험행동으로 인한 피해를 최소화할 수 있는 대응 방안을 제시하는 데 있다. 이를 위해 첫째, 정신장애의 발생율과 정신장애인 범죄의 현 황과 증감추세 및 범죄에 대한 두려움을 논해 보았다. 둘째, 정 신장애인의 범죄행동들 중 그 피해가 심각했던 사건에 대한 언 론매체들의 보도자료를 통해 정신장애인 범죄행동의 전후 상황 과 경찰의 초동수사적 대응을 추적하였다. 마지막으로, 2016.5. 30. 개정된 “정신건강복지법”의 내용 중 정신장애인의 인권을 강화하기 위한 다양한 입원요건과 절차를 검토해 보았다. 정신장애인의 위험행동이 더욱 심각한 범죄행동으로 악화되지 않고 당사자에게 치료적 기회를 주기 위해서는 경찰관들의 현장 에서의 초동조치는 가족/이웃주민/지자체/정신장애 전문 의료인/ 병원 등이 연계되는 통합적인 시스템에 의해 이루어져야 한다.
