Through the analysis of the current status of the nation's gambling-related regulatory bills and prior studies, this study was conducted to derive improvement measures that could promote both management of gambling and protection of related industries. Through the analysis of the current legal framework and prior research, the following were derived: First, it was judged that gambling under the current criminal act goes against the Principle of Proportionality and violates the rule of clarity. Therefore, it is necessary to eliminate the current gambling charges and maintain only habitual gambling charges. Secondly, it is necessary to select one organization to integrate gambling-related industries with regard to the direction of improvement in the special law and to establish a basic law centered on it. In addition, regulations on each field should be self-regulated in principle. Based on these findings, the study made the necessary suggestions for the development of future gambling regulation legislation.

이 연구는 우리나라의 도박관련 규제법안의 현황과 선행연구들에 대한 분석을 통해, 도박 에 대한 관리와 관련 산업의 보호라는 양자 모두를 도모할 수 있는 개선방안을 도출하기 위하 여 수행되었다. 현행법 체계와 선행연구 분석을 통해 다음을 도출하였다. 첫 번째로 현행 형법상의 단순도 박죄는 과잉금지의 원칙에 반하고 명확성의 원칙에도 위반한다고 판단하였다. 따라서 현행 단순도박죄를 삭제하고 상습도박죄만을 존치시킬 필요가 있다. 두 번째로 특별법상의 개선방향과 관련하여 도박관련 산업을 통합할 하나의 기구를 선정하 고 이 기구를 중심으로 한 기본법을 제정할 필요가 있다. 또한 각 분야에 대한 규제는 자율규 제를 원칙으로 하여야 할 것이다. 이 연구에서는 이러한 연구결과에 근거하여 향후 도박규제 법안의 발전을 위해 필요한 제언을 하였다.
