Since its enactment, ｢Support for Small and Medium Enterprise Establishment Act(hereinafter "the Act")｣ has been amended numerous times in order to reflect the changes in the national start-up policy and various the political and social needs. The Act is an important law that supports start-up businesses from its preparation stage to re-start stage, and is actually being applied throughout various stages of start-up; a number of laws concerning small and medium enterprises cite or relate to this law. The contents of the law regarding support of start-up businesses depend on policy judgment. Thus, this report deals with ① the expansion of the scope of start-up, in accordance with the revision of the definition of "business start-up" and "business starter" in the Act, and ② the matters related to the promotion of start-up by introducing the concept of technology start-up to cope with the era of transition to the digital economy, reviews ③ the matters regarding promotion of start-up through improvement of start-up procedure, which corresponds to the act of registration of a private business and incorporation of a corporation. First of all, this report establishes the need for clarifying the definition of "business starter" to mean a new establishment and suggests the criteria for its judgment registration for a corporation and business license registration for a private business owner. In addition, with respect to business starters, this report provides a review on the ways of interpreting specific exceptions from start-up in the current Enforcement Decree of the Act. Next, in order to introduce the legal concept of technology start-up, this report emphasizes that categorization based on the degree of technological innovativeness and knowledge-intensiveness must be made possible. Based on the premise that it is necessary to take into consideration the need to include the current contents of the technology start-up related laws, a method of actual screening, instead of an approach based on classification of industry, must be employed. With respect to the procedure of start-up, this report suggests a way to systematically improve the current provision on corporation registration by excluding seal imprint, based on the examination of effectiveness of seal imprint, which current provision on corporation registration customarily requires.

｢창업지원법｣은 제정이후 국가의 창업 정책 변화 및 여러 가지 정치적·사회적 개 정 수요를 반영하여 수차례 개정을 거쳐 왔다. ｢창업지원법｣은 예비창업자부터 창업 자, 재창업자를 모두 지원하는 법으로 실제 창업 전반에 적용되고 있으며, 이 법을 인 용하고 있는 중소기업 관련 법령이나 그 밖의 관계 법령이 다수 존재하고 있는 중요한 법률에 해당된다. 실제 창업자에 대한 창업지원 관련 법률의 내용은 주로 정책적 판단에 따른 것이므 로 ① ｢창업지원법｣의 창업, 창업자 정의 규정 개정에 따른 창업 인정 범위의 확대와 ② 디지털 경제체제로의 전환 시대에 대응하기 위한 기술창업 개념의 도입으로 인한 창업활성화에 관한 사항을 다루고, 실제 개인사업자 등록과 법인설립 행위에 해당하는 ③ 창업절차의 개선을 통한 창업활성화 방안에 관한 사항을 검토하였다. 우선 창업, 창업자 정의에 대해서는 창업을 ‘새로 설립’에 해당하는 것으로 명확히 하면서 그 판단기준을 법인인 경우 등기, 개인사업자인 경우 사업자등록을 기준으로 하는 것으로 정립할 필요가 있다는 점에서 정리하였고, 창업자에 대해서는 현행 ｢창업 지원법 시행령｣의 구체적인 창업 제외사유의 해석에 대한 기준을 새로 검토하였다. 다음으로 기술창업을 법적인 개념으로 도입하기 위해서는 기술혁신정도, 지식집약정 도에 따라 분류가 가능하여야 한다. 현재 기술창업 관련 법령에서 포함하고 있는 내용을 포괄할 수 있도록 고려하여 설정할 필요가 있다는 점을 전제로 단순히 업종의 분류 에 따른 접근 방식이 아닌 실질 심사가 가능한 방식이 되어야 할 것이다. 창업절차의 개선에 대해서는 법인설립 과정에서 관행적으로 요구되고 있는 인감증 명서에 대한 실효성 검토를 바탕으로 제도적 개선방식으로서 인감증명을 제외하는 법 인등기 관련 규정의 개선방안을 제시하였다.
