In addition to the existing various support systems for Local Small & Medium sized Enterprises(SMEs), new policies targeting local SMEs that project regional values, such as balanced regional development, have recently gained more attention. However, apart from the necessity at the policy level, the limitations of the current legal system related to local SMEs are emerging. The legal basis for local SMEs was first established through the ｢Act on Balanced Regional Development and Fostering Local Small & Medium Enterprises｣ enacted on January 7, 1994. Later, it was transferred to Chapter 4, Section 10 of the ｢Act on the Promotion of Small & Medium Enterprises｣. In the case of the current ｢Act on the Promotion of Small & Medium Enterprises｣, it is a law that plays a role as a practical general law on local SMEs. However, in the case of this law, only passively settled within the framework of “local small & medium enterprises,” and faces the limit of not effectively addressing the policy issues that continue to be raised against local SMEs. In addition, various laws related to small and medium-sized enterprises stipulate regional small and medium-sized enterprises, but the systematic rules for regional SMEs are largely insufficient. Meanwhile, in laws related to balanced regional development, such as the ｢Special Act on Balanced National Development｣, there is a connection between the rules related to local SMEs. However, since it is composed mainly of matters that are being promoted macroscopically from the viewpoint of revitalization of local industry and economy, not local SMEs, the legal basis for specialized intensive support focusing on local SMEs can be pointed out as a problem. In seeking to improve the legal system for fostering local SMEs and promoting innovation, it is necessary to take into account the harmonious relationship with the existing laws and regulations while effectively accepting the core policy values related to local SMEs. As a result of comparing and reviewing the improvement directions based on these factors, it was confirmed that the main legislative task is to enact a separate law for fostering local SMEs and promoting innovation. In order to alleviate concerns that the enactment of a new law on local SMEs will mass-produce another over-legislative law, the conceptual category of regional SMEs should be set reasonably and the discrimination should be clearly emphasized in terms of the purpose and content of discipline.

기존의 중소기업 전체를 대상으로 한 각종 지원 체계과 별개로 지역균형발전 등의 지역적 가치를 투영하고 있는 지역 중소기업을 대상으로 한 새로운 육성 정책이 최근 들어 더욱 각광을 받고 있다. 하지만 이러한 정책적 차원에서의 필요성과 더불어 지역 중소기업과 관련된 현행 법제도상의 한계도 동시에 나타나고 있는 실정이다. 지역 중 소기업에 대한 법적 근거는 1994년 1월 7일 제정된 이후 ｢지역균형개발 및 지방중소 기업 육성에 관한 법률｣을 통하여 처음으로 마련되었는데 이후 ｢중소기업진흥에 관한 법률｣ 중 제4장 제10절 ‘지방 중소기업의 육성’으로 이관되기에 이르렀다. 이와 같은 현행 ｢중소기업진흥에 관한 법률｣의 경우 지방중소기업에 관한 실질적인 일반법으로 서의 역할을 수행하고 있는 법령으로 판단되며, 지방중소기업의 육성을 위하여 필요한 정책 사항이 전개되어 나감에 따라 그때그때 필요한 규정의 부분적 개선이 이루어져 왔다. 하지만 동 법률의 경우 ‘지방중소기업’의 틀 내에서 소극적으로 안주하고 있을 뿐, 지역 중소기업을 대상으로 하여 계속해서 제기되고 있는 정책적 화두를 효과적으 로 담아내지 못하고 있는 한계에 봉착하고 있다. 그 밖에 중소기업과 관련된 제반 법령 에서도 지역 중소기업을 규정하고는 있으나 지역 중소기업에 관한 체계적인 규율이 크게 미흡하다. 한편 ｢국가균형발전 특별법｣ 등의 지역균형발전과 관련된 법률에서도 지역 중소기업과 관련된 규율의 연관성이 나타나고 있으나 지역 중소기업이 아닌 지역 산업 및 경제의 활성화라는 관점에서 거시적으로 추진되고 있는 사항 위주로 구성되어있어 지역 중소기업에 초점을 둔 특화된 집중적인 지원의 법적 근거가 미흡하다는 것 이 문제점으로 지적될 수 있다. 지역 중소기업의 육성과 혁신촉진을 위한 법제개선방 향 모색에 있어서 지역 중소기업과 관련된 핵심적 정책 가치를 효과적으로 수용하면서 도 기존 법령상 규율과의 조화로운 관계를 감안할 필요가 있다. 이러한 고려요소를 토대로 개선방향을 비교 검토한 결과 지역 중소기업의 육성 및 혁신촉진을 위한 별도 의 법률을 제정하는 것이 가장 합리적인 방안임을 확인할 수 있었다. 지역 중소기업의 육성과 혁신촉진을 위한 입법과제로는 지역 중소기업 육성 및 혁신촉진을 위한 거버넌 스 체계 개선, 혁신적 지역 선도기업의 발굴ㆍ육성과 입지 제도 도입, 지역 중소기업 의 육성ㆍ혁신촉진을 위한 별도의 기금 신설, 지역 중소기업에 대한 위기의 선제적 대응 체계 구축 등을 제시하였다. 지역 중소기업에 관한 신법 제정이 또 하나의 과잉입 법을 양산할 것이라는 우려를 해소하기 위해서라도 지역 중소기업의 개념 범주를 합리 적으로 설정하고 규율목적과 내용 등에 있어서 차별성을 명확하게 부각시켜 나가야 할 것이다. 지역 중소기업이 지역 경제와 산업을 활성화시키는 핵심 기능을 수행해 나갈 수 있도록 유관 법제도의 종합적인 정비 노력이 병행되어야 할 것이다.
