The right of thought and freedom of speech is not the one that a country can control or allow its citizens to have of its own accord. It is the natural right and at least human rights that are needed to develop the human character and human nature.It is meaningful that we take a look at how much we are enjoying the freedom of speech in these days, what meaning it has to our life, what moral duty it is accompanied by, to what extent it can go and what negative aspects it has.For these purposes, above all, we have to examine the thoughts of John Stuart Mill who asserted perfect 'freedom of speech' in his book "On Liberty" and the opinions of those who were critical to his thoughts. We should inquire into not only tolerance on which freedom of speech is formed but also the importance of freedom of speech and moral duty by which it is followed. I think that this research will help give us a sound view to the freedom of speech when we live in a democratic society.

사상과 표현의 자유라는 권리는 국가가 임의로 억제하거나 허락해 줄 수 있는 것 혹은 국가가 허락해 줄 수 있는 권리가 아니다. 그것은 인간의 본성과 인간의 인간성의 발전을 위해 필요한 여러 조건들에 기초한 자연적인 권리며, 혹은 적어도 인권이다.이 시대를 살고 있는 우리가 얼마나 언론의 자유를 누리고 있으며, 언론의 자유는 인생에 어떤 의미가 있으며, 언론의 자유에 따른 도덕적 의무는 무엇이며, 그 한계는 어디까지 이며, 언론의 자유에 따른 부정적 기능은 무엇인지 등을 살펴보는 것은 큰 의의가 있다. 이러한 목적을 위해, 우리는 먼저 『자유론』에서 완전한 ‘언론의 자유’를 주장한 존 스튜어트 밀 (John Stuart Mill)의 사상과 밀의 사상에 대해 비판적인 사람들의 견해를 살펴보아야 할 것이다. 또한 언론의 자유의 성립을 위한 덕목인 관용뿐만 아니라, 언론자유의 중요성과 언론자유에 따른 도덕적 의무에 대해서도 살펴보아야 할 것이다. 나는 이러한 고찰들이 자유 민주 사회에서 살고 있는 우리들에게 ‘언론의 자유’에 대한 건전한 시각을 형성하는데 많은 도움을 주리라 생각한다.
