The main purpose of this paper is to draw a distinction between two different types of morality: “Compulsory morality” imposes normative coercion, while “Advisory morality" offering various human values and ideals. This distinction has long been neglected or overlooked by the tradition of normative ethics, whose main aim is to find a universal principle of morality. By distinguishing between compulsory and advisory moralities, we may see that the key subject of ethics should be to define the sphere of compulsory morality. And I suggest the liberalist principle of ‘harm to others’ a la J. S. Mill as the most plausible candidate to do the job. Once the sphere of Compulsory morality is set up, matters beyond that sphere may rightly be considered as offering private values or virtues, in the sense that they lack the ground for ‘normative coercion’. This will show us that the deepest mistake of the mainstream absolutist moral theories is their exclusive pursuit after the ultimate sources of ‘the good’. Instead, this urges that our central concern of ethical inquiry be on the matter of drawing the boundary of the sphere of Compulsory morality. I would like to name this new inquiry “the ethics of the bad.”

본 논문의 주된 목적은 본성상 매우 다른 층위의 도덕을 금지의 도덕과 권고의 도덕으로 구분하려는 것이다. 금지의 도덕은 전형적으로 “～하지 않아야(해야) 한다”라는 형태를 띤다. 따라서 금지의 도덕은 ‘규범적 강제성’을 수반하는 반면, 권고의 도덕은 더 나은 인간의 삶을 위한 다양한 이상들을 제시한다. 전통적인 규범윤리학은 대부분 이 구분의 중요성을 간과하고 있으며, 오늘날 그것을 넘어서려는 다양한 형태의 윤리학적 논의에서도 상황은 크게 다르지 않다. 필자는 ‘도덕적인 것’을 규정하는 핵심적 특성이 ‘규범적 강제성’이라는 사실을 축으로 금지의 도덕과 권고의 도덕의 본성적 차이가 선명하게 드러날 수 있다고 본다. 이러한 관점에서 필자는 다양한 사회적문화적 변이 가능성에도 불구하고 ‘타인에 대한 해악’이라는 밀의 자유주의 원리가 규범적 강제성을 규정하는 실험적 원리가 될 수 있다고 본다. 금지의 도덕과 권고의 도덕 구분은 먼저 이 두 가지 도덕을 포괄하는 보편적 도덕 원리를 추구하는 절대주의적 도덕 이론의 난점의 소재를 드러내 줄 것이며, 나아가 윤리학의 핵심적 관심사가 금지의 도덕의 영역을 설정하는 문제라는 점을 보여 줄 것이다. 이것은 ‘좋은 것의 윤리학’으로부터 ‘나쁜 것의 윤리학’에로의 전환을 의미한다.
