It is needless to say that a peaceful world without war has been the hope for mankind throughout the ages. However, despite our hope, there has not bee a single day without war in our world. Violence and massive bloodshed accompanies war and draws tragedy to mankind. Nevertheless, the subject of war has never been the most attractive topic for many philosophers. Only a few scholars have brought up the issue about war and its morality, but a lack of interest still exists today. However, the Vietnam War succeeded in bringing adverse criticism about war and morality from philosophers. War brings unbearable sadness and suffering to mankind; therefore philosophers become interested in the ethics of war. They think about morality as having a major role in war and what it can do to enhance its role. Morality has produced intellectual traditions such as Pacifism, Realism, and the Just War. The Legitimate Theory of War means that in certain situations likewar, it attempts to keep the most ethical side even in difficult situations in which it has no other option but war itself. Peace is their ultimate goal. Since human history began, peace and war have been the most paradoxical concept in human society. But at the same time, keeping the ethical side of war and pursuing peace is the fate of mankind. Philosophers need to contribute more interest in world peace and participate more in ethical efforts to stop war. This paper looks at four major issues related to war with a focus on the Just War. 1)Formatting Process of the Just War. 2)Existence of the original theory of the Just War. 3) The theory of the Just War in modern-day society on the original theory. 4)Determining the legitimacy of the war in Iraq

전쟁이 없는 평화스러운 세상, 그것은 어느 시대를 막론하고 인류의 희망이 되어 왔다. 그러나 그런 인류의 희망과는 달리 이 세상에서는 전쟁이 그치는 날이 거의 없었다. 전쟁은 폭력과 살상을 수반하고 인간을 비극으로 이끈다. 그럼에도 불구하고 전쟁의 주제에 대한 철학자들의 관심은 그리 높지 않다. 극히 소수의 철학자들만이 전쟁과 도덕성에 관하여 논의를 제기했고, 그것도 철학자들의 관심을 별로 끌지 못했다. 그러나 월남전은 철학자들에게 전쟁과 도덕성에 관해서 논란을 불러일으키는데 성공했다.전쟁은 인간에게 너무나 크나큰 슬픔과 고통을 가져다주기에 철학자들은 또한 전쟁자체의 옳고 그름에 대하여 관심을 갖게 되었다. 만약 도덕성이란 것이 전쟁에서 모종의 역할을 한다면 어떤 역할을 할 수 있는 지를 생각해 왔었다. 그것은 세 가지의 지적 전통을 낳았으니, 평화주의, 현실주의, 정당한 전쟁론이 그것이다. 정당한 전쟁론은 전쟁이라는 특수상황에서 그리고 전쟁을 할 수밖에 없는 궁지에서도 최대한의 윤리성을 유지하려는 진지한 노력의 산물이라고 할 수 있다. 평화는 우리의 궁극적인 목표이다. 인간 역사가 시작되면서부터 전쟁과 평화는 인간 사회의 가장 역설적인 개념이 되어 왔다. 그러나 그런 가운데서도 최대한 윤리적 노력을 가지고 평화를 추구할 수밖에 없는 것이 인류가 처한 운명이다. 이 문제에 대해서 우리 철학자들은 많은 관심을 가지고 윤리적 노력으로 종전보다 더더욱 인류의 평화에 이바지할 때이라고 생각 된다 이런 의도로 본 논문에서는 도덕적으로 정당한 전쟁론을 중심으로 하여 1)정당한 전쟁론의 형성과정, 2) 고전적인 정당한 전쟁론의 성립, 3) 이 토대 위에서 만들려진 현대에 있어서 정당한 전쟁론 4)그리고 이라크 전쟁은 도덕적으로 과연 정당했는가를 살펴보고자 한다.
