Massey and Finocchiaro contend that the theory of fallacy is impossible or there are no fallacies because we cannot find satisfiable definition of fallacies. After examining their criticism, this paper responds to them by saying that even if their remarks on textbooks are plausible, their conclusion doesn’t follow. Then I present new theory of fallacy, which says that (i) a fallacy is defined as an argument violating the standards of good arguments, (ii) there are various kinds of fallacies from trivial ones to fatal ones, (iii) it takes neutral attitude on which theory is acceptable about good arguments, and (iv) an argument is extended to include argumentation. Finally, this paper examines the definition of fallacy provided by Professor Yeo.

매시와 피노치아로는 오류의 정의가 문제점이 있음을 지적하고 그것을 근거로 오류에 관한 이론이 불가능하거나 오류라는 것이 아예 없다고 비판한다. 이 논문에서는 이 비판을 살펴보고 그에 대한 대답을 하려고 한다. 곧 오류의 정의에 관한 그들의 문제 제기는 그릇된 부분이 있으며 설령 옳다고 하더라도 그들이 원하는 결론은 도출되지 않음을 보이려고 한다. 그리고 오류에 관한 새로운 정의를 내리겠다. 나는 올바른 논증의 기준을 어긴 것을 오류로 정의하는데, 이때 경미하게 잘못된 논증부터 심각하게 잘못된 논증까지 다양한 오류의 정도를 인정하며, 논증도 논증 활동의 의미로 사용한다. 그리고 올바른 논증의 조건에 대해서는 중립적이다. 마지막으로 이 정의를 토대로 여영서 교수의 오류의 정의를 검토하겠다.
