(1) The purpose of this essay is to analyze the causes of moral values such as guilt, punishment and justice, and their relationship with the idea of bad conscience. The hitherto generally accepted view on them is the debt theory that a bad conscience is feelings of debt and the idea of guilt is nothing but a formal change from an extremely material concept into an abstract one. In other words, the theory has a simple formula that feelings of debt cause guilty consciousness and bad conscience. However, is there any reason that the theory is true? The question is the main issue of this essay. (2) To conclude, I suggest that a bad conscience does not originate from the conventional implication of guilt and punishment that they are merely considered as objects of an equivalent exchange between them, but from the different type of implication of them that they are understood in terms of responsibility and revenge. Accordingly, the conventional view that feelings of debt cause guilty consciousness and bad conscience is much less plausible than my suggestion that free will causes a sense of responsibility and bad conscience.

(1) 이 논문은 『도덕의 계보』 제2논문 -「‘죄’, ‘양심의 가책’ 그리고 그와 유사한 것들」-을 중심으로, ‘죄와 형벌, 정의라는 도덕적 가치들이 어떻게 발생한 것이며, 그것은 양심의 가책과 어떠한 관계가 있는가?’를 분석해 보는데 목적이 있다. 지금까지 이에 대해 논의된 일반적 견해는 이른바 ‘부채이론’이다. 부채이론이란, ‘양심의 가책은 곧 부채감이며, 부채라는 지극히 물질적인 개념이 형식적인 변이를 일으킨 것에 불과한 것이 곧 죄 개념이다’라는 이론이다. 간단히 표현하면, ‘부채감=죄의식=양심의 가책’이라는 등식이다. ‘과연 그럴까?’ 이것이 이 논문의 문제의식이다. (2) 결론적으로, 양심의 가책은 그 기원에 있어서 죄와 형벌, 즉 등가 교환의 대상으로 이해되었던 죄와 형벌이 아니라, 잘못 이해된 죄와 형벌, 즉 책임과 복수의 논리를 통해 이해된 죄와 형벌에서 발생한 것이다. 따라서 ‘부채감=죄의식=양심의 가책’이라는 등식이 아니라, ‘자유의지=책임의식=양심의 가책’이라는 등식으로 해석하는 것이 바람직하다고 필자는 생각한다.
