This paper aims to tell unjustness of the antithesis between contemporary theory of human rights and utilitarianism by showing the two, one of which is that some of contemporary theory of human rights consist of incompatible basic human rights and the other of which is that the grounds of an argument which argues that utilitarianism denies the right and liberty of a person are groundless. The basis of the antithesis between contemporary theory of human rights and utilitarianism is that the criteria of moral rights should be distributive and egalitarian one or aggregative and utilitarian one. Contemporary theory of human rights emphasizes on indispensible individual human rights, however, all rights are not distributive nor egalitarian. Mill, a representative utilitarian, doesn't deny human right but argues liberty as an individual human right, at the same time he takes utilitarian principle as more fundamental one. Futhermore, he argues nurture of autonomy of an individual who is supposed to develop one's humanity through participation in politic institutions. By challenging unjustness of the antithesis between contemporary theory of human rights and utilitarianism, I will seek the methodology for complement relationship between the two by changing focus of human rights from distributive and egalitarian one or aggregative and utilitarian one to nurturing autonomy of an individual and ensuring liberty.

인권과 민주주의 등과 같은 규범적 가치들은 그 정당성이 충분히 검토되기 이전에 우리 사회가 현대화되는 과정에서 추구된 것들이고, 이러한 가치들은 근대화과정에서 무시되었거나 혹은 왜곡되어 사용되었다. 우리는 ‘개인’의 절대적 자유의 보장에 초점을 둔 인권보다는 공동체 전체의 생존이 더 우선한다는 과거 ‘한국적 민주주의’에서 그 왜곡과 무시의 원형을 찾아볼 수 있다. 다문화사회에서 예측, 진행되는 여러 인권 유린의 상황에서 ‘한국적 민주주의’는 비판, 극복되고 지양되어야 할 가치일 것이다. 인권 및 사회 정의의 객관적 정당성을 주장하는 일부 인권에 대한 논의는 마치 ‘아시아적 가치’ 담론 비판과 유사성을 갖는 것처럼 보인다. 그 가운데 ‘개인’의 절대적 자유 보장에 초점을 두지 않고 전체의 효용을 더 우선시 한다고 ‘공리주의’ 이론을 비판하는 것으로써 ‘인권’의 객관적 정당성을 주장하는 입장이 있다. 연구자는 그러한 비판이 공리주의자 밀의 주장에 해당하지 않는 것이라고 생각한다. 오히려 공리주의자인 밀은 개인의 거의 ‘절대적’ 자유를 주장하기 때문이다. 이 글에서 연구자는 현대인권론과 공리주의의 대립이 부당하게 설정되었다는 것을 말하고자 한다. 이를 위해 연구자는 현대인권론의 다양한 형태와 주장의 다양성을 검토하여 개인의 어떤 권리를 주장하고 있는가 그 차별성을 부각시킴으로써 그러한 대립의 부당성의 근거를 제시하고, 공리주의자 밀의 개인, 권리에 대한 이해를 통해 공리주의의 주장에서 인권 이념의 내적 함축을 보여줌으로써, ‘인권’의 객관적 정당성을 현대인권론자와는 다른 방식으로 제시하고 두 이론의 보완을 모색해 보고자 한다.
