At the outset of 1800s, Bentham came to resolutely defend Representative Democracy, experiencing a critical transition of his political thinking to the so-called ‘political radicalism.’ Many commentators have pointed to his recognition of the existence of the ‘sinister interest’ of ruling class as a decisive momentum of this transition. His recognition of the sinister interest is interpreted as having brought him a new idea about the political circumstance best for the realization of the utilitarian ultimate end, that is, the greatest happiness of the people in general. In other words, it has urged him to select democracy as a new measure or strategy. For Bentham, on this interpretation, democracy is not an end in itself but merely a measure or strategy which may serve the constitution of ‘good governance’ in the utilitarian sense. This being so, it may be seen that his later political theory is centered on the exposition of those instrumental devices which are designed to suppress the sinister interest of ruling class. In this view, his political theory must be seen to be primarily a theory of ‘governance’ or ‘statecraft.’ It seems to me, however, that a fair evaluation of the reformative suggestions raised in his later political theory reveals that democracy was for him not merely an optional or strategic instrument for the greatest happiness of the people in general. Such suggestions appeared in his later works as virtually universal suffrage, public opinion tribunal, and official public archive etc. may be taken to be maintaining that the greatest happiness of the people in general can be achieved only by the expansion of political commitment of the people. On this view, I shall assert in this paper that at least in his later political theory Bentham realizes that a government ‘for the people’ must be the one ‘by the people’ as well as ‘of the people,’ and that his utilitarianism incorporates the fundamental principles of democracy as indispensable conditions for its realization in the actual world.

1800년대 초반 벤담은 정치적 사유의 중대한 전환, 소위 ‘정치적 급진주의’로의 전환을 겪으면서 대의민주주의를 강력히 옹호하게 된다. 흔히 이러한 전환의 가장 결정적인 계기로 지목되는 것은 통치계급의 ‘사악한 이해관심’의 존재에 대한 그의 인식이다. 이러한 인식은 공리주의적 목적, 즉 ‘최대 행복’의 실현에 적합한 정치적 환경에 대한 새로운 생각, 요컨대 새로운 수단 혹은 전략의 선택으로 해석된다. 이러한 해석에 따르면, 그에게 민주주의는 그 자체로 목적이 아니라 어디까지나 공리주의적 의미의 ‘좋은 통치’를 구성하기 위한 수단들 중 하나다. 그렇기 때문에 그의 말년의 정치이론은 통치계급의 사악한 이해관심의 억제를 위한 여러 도구적 장치의 설명에 집중된다. 이러한 관점에서 그의 정치이론은 근본적으로 ‘통치방식’ 혹은 ‘국가운영기술’의 이론이라는 성격을 갖는다. 그러나 필자가 보기에 벤담이 말년의 정치이론에서 제시한 개혁 제안에 대한 공정한 평가는 그에게 민주주의가 국민의 최대 행복을 위한 단순한 선택적・전략적 도구 이상의 의미를 가진다는 점을 밝혀준다. 말하자면 실질적인 보편적 선거권과 여론 법원 및 공공 기록보관소 설치의 헌법적 보장에 대한 그의 제안은 국민의 최대 행복은 결국 국민의 정치참여 확대를 통해서만 실현될 수 있음을 역설한 것이라고 해석될 수 있다. 이러한 해석에 입각하여, 필자는 적어도 말년의 벤담은 ‘국민을 위한’ 정부는 결국 ‘국민에 의한’ 정부인 동시에 ‘국민의’ 정부여야 한다고 인식했고, 그의 공리주의는 현실 세계에서 그것의 실현을 위한 필수불가결한 조건으로 민주주의의 기본 원칙들을 포용한다고 주장할 것이다.
