The forces who use hate speech themselves claim that their arguments are legitimate logical reasoning based on ‘facts’. So this paper aims to analyze the logical justification of the reasoning. First, we look at the definition and characteristics of hate speech. It then analyzes whether the 'facts' that hate speech presupposes are really true and, even if they are true, whether conclusions can be validly drawn. I will show that most hate speech does not pass the fact check. Some hate speech takes the form of ‘statistical discrimination’, which draws discriminatory conclusions on the basis of the statistical features found to be facts, which are widely accepted as a form of legitimate reasoning. This paper attempts to analyze whether statistical discrimination is indeed the valid form of argument from the ethical point of view and thus show that it is not.

혐오 표현을 하는 세력들은 스스로 자신들의 주장이 ‘팩트’에 근거한 정당한 논리적 추론이라고 주장하고 있다. 그래서 이 논문은 그 추론의 논리적 정당성을 분석해 보는 데 목적이 있다. 먼저 혐오 표현의 정의와 특징을 살펴본다. 그 다음에 혐오 표현이 전제로 삼는 ‘팩트’가 정말로 사실인지, 그리고 그것이 사실이더라도 결론이 도출되는지 분석한다. 대부분의 혐오 표현은 ‘팩트 체크’를 통과하지 못함을 보여 줄 것이다. 일부 혐오 표현은 사실로 밝혀진 통계적 특징을 근거로 차별적인 결론을 끌어내는 ‘통계적 차별’의 형식을 띠는데, 이것은 정당한 추론의 형식으로 많이 받아들여지고 있다. 이 논문은 통계적 차별이 윤리적으로 과연 올바른 논증 형식인지 분석하여 그렇지 않음을 보여 주려고 한다.
