What is the essence of Bentham’s political radicalism? We may finish, as many scholars did actually, by distorting Bentham’s thought, if we apply to him the political frame offered by the historical debate between Burke and Paine, which still represents the conflict between the conservative and the progressive. For an accountable evaluation of Bentham’s radicalism, it is urgent that we should detach him from this frame. In this Paper, I will (a) expose Bentham’s critique against two sides in his Fragment on Government and Anarchical Fallacies, and (b) bring out Bentham’s original point of view about the government, and (c) examine Bentham’s conception of sovereignty and of public opinion tribunal in his Constitutional Code with the intention of showing why Bentham adhered to the system of representative democracy.

벤담 급진주의의 정확한 실체는 무엇인가? 버크 대 페인의 정치논쟁으로 대변되는 진보와 보수의 대결구도 하에서 벤담의 급진주의는 실체적으로 왜곡되기 일쑤였다. 어떤 면에서 그의 이론이 급진적인지를 파악하기 위해선 이 친숙한 진보와 보수의 구도로부터 벗어나는 일이 급선무이다. 필자는 『정부에 관한 단상』과 『무정부주의적 오류』를 통해 각 진영에 대한 벤담의 비판을 살펴보고, 이를 바탕으로 벤담 정치이론의 독창적 면모를 부각시켜 볼 것이며, 『헌법전』의 ‘주권’ 개념과 ‘여론법정’ 개념을 중심으로 민주주의에 관한 벤담의 입장을 검토해 볼 것이다.
