In 2020, we are experiencing many changes due to the infectious disease called coronavirus. The government is making efforts to curb the spread of coronavirus through social distance between people. Despite the government's continuous efforts, however, the coronavirus keep spreading. The Coronavirus is causing serious damage to the national economy due to the cancellation of meetings and various events in order to ban people-to-people contact. In order to relieve the damage that people suffer from the coronavirus, the government and local governments are trying to provide emergency disaster support so that they can live a decent life. The government paid emergency disaster support funds to the entire nation. Such funds should be applied to tax legalism by being based on the taxes financed by the people's funds and aslo it should be in accordance with the rule of lawto clearly define the expenditure. The current legislation, however, does not have any specific stipulations on the provision of emergency disaster assistance tohelp relieve damage caused by the coronavirus. In order to payemergency disaster support funds, for example, the U.S., the U.K. and Japan stipulate the details of the payment in individual laws. In particular, in the case of the U.S. and Japan, individual lawson emergency disaster support provide various details on the payment of disaster support funds and other support. In order to protect the people's economy through emergency disaster support funds, specific details should be prepared in the law. Therefore, this study analyzed the Korea-Japan legal system for emergency disaster support fund on the premise that specific legislation for the payment of emergency disaster support funds and the procedures for payment should be set up to cope with emergency disasters such as coronavirus.

2020년 한해는 우리사회에 코로나바이러스라는 감염병으로 많은 변화를 경험하고 있다. 정부는 코로나바이러스 확산 방지를 위하여 사람들간의 사회적 거리두기를 통하여 전염 억제를 위한 노력을 기울이고 있다. 그러나 사회적 거리두기 등 정부의 지속적인 노력에도 코로나바이러스는 계속 확산되고 있는 상황이다. 코로나바이러스로 인한 사람간의 접촉 금지로 각종 모임과 행사 취소 등으로 국민경제는 심각한 피해를 받고 있다. 코로나바이러스로 인해 국민들이 받는 피해를 구제하기 위해 국가와 지방자치단체는 긴급재난지원금 등을 지급하여 최소한의 인간다운 생활을 할 수 있도록 노력하고 있다. 국가는 긴급재난지원금을 전 국민 대상으로 지급하였다. 이러한 긴급재난지원금은 국민의 재원으로 마련된 조세에 의한 것으로 조세법정주의가 적용되어야 하며, 그 지출에 대하여 법률에서 명확히 규정하여 법치주의에 부합하여야 한다. 그러나 현행 법제는 코로나바이러스로 피해 구제를 위한 긴급재난지원금 지급에 대한 어떠한 구체적인 명문규정을 두고 있지 않다. 긴급재난지원금을 지급하기 위하여 미국, 영국, 일본 등은 개별 법률에서 지급에 구체적인 내용을 규정하고 있다. 특히 미국과 일본의 경우는 긴급재난지원에 대하여 개별 법률을 규정하여 재난지원금에 대한 지급과 그 외 지원에 대한 다양한 내용을 규정하고 있다. 이처럼 긴급재난지원금을 통하여 국민의 경제보호를 위해서는 법률에서 구체적인 내용을 마련하여야 한다. 따라서 본 연구는 코로나바이러스와 같은 긴급재난에 대응하기 위하여 긴급재난지원금을 지급하기 위한 구체적인 입법안과 지급 등에 한한 절차 등이 마련되어야 한다는 전제하에 한‧일간 긴급재난지원금 법체계를 분석하였다.
