The purpose of this article is to explore a way to protect against whistleblowers. Accordingly, the significance and necessity of protecting whistleblowers is first emphasized, and the limits of whistleblower protection are identified through current labor laws and precedents. The next chapter examines the main contents of the ‘Directive on the protection of persons who report breaches of Union Law’ adopted by the EU. This directive specifically stipulates the requirements and procedures to highly protect whistleblowers, which suggests a reasonable balance for the realization of workers' whistleblowing rights and public interests, as well as protection of employers' infringement benefits. Through the discussion above, as a last resort to protect whistleblowers, this article tries to deal with legislation and interpretation in labor law. In other words, this paper proposes the way about the expansion of the scope of whistleblowing, rational beliefs on the contents of whistleblowing, the provision of whistleblowing procedures, prohibition of retaliation, exemption clauses and remedies.

이 글은 내부고발 근로자에 대한 보호방안을 강구하는 데 목적이 있다. 이에 따라 먼저 내부고발 근로자 보호의 의의와 필요성을 강조하고 현행 노동법제와 판례를 통해 내부고발 근로자 보호의 한계를 확인하였다. 다음으로 최근 유럽연합에서 채택된 내부고발자 보호지침의 주요 내용을 살펴본다. 이 지침은 내부고발자를 두텁게 보호하기 위해 요건과 절차를 구체적으로 규정하고 있는데, 여기서 내부고발에 따른 사용자의 침해이익의 보호 뿐 아니라 근로자의 내부고발 권리와 공익의 실현을 위한 합리적 균형을 시사한다. 이상의 논의를 통해 마지막으로 내부고발 근로자 보호방안으로서, 내부고발 대상범위의 확대, 내부고발 내용에 대한 합리적 믿음의 해석, 내부고발절차의 마련, 보복금지와 면책조항, 구제방안 등을 제시하였다.
