This Study aims at analyzing legal issues in the course of operation of the automotive rules of origin for USMCA. The purpose of FTA rules of origin is to provide preferential tariff treatment for the originating goods. Thus, it is very important to understand key features of the USMCA automotive rules of origin in order for importer, exporter, and producer to claim a preferential tariff treatment. Major changes made under the USMCA rules of origin may include substantial increases of Regional Value Content levels on passenger vehicle, light truck and heavy truck, and relevant parts. A new requirement of usage for steel and aluminum produced in the North American Countries is also adopted. In addition, a novel concept of Labor Value Contents is introduced under the USMCA. This study anticipates disagreements and potential disputes may arise from the USMCA automotive rules of origin due to the complexity and ambiguity of the texts. Although Korea is not a Party to the USMCA, understanding on the USMCA automotive rules of origin is critical because many Korean companies export main items such as car and car parts to the North American Market and operate manufacturing facilities over there.

본 연구는 USMCA 자동차 분야 원산지 규정에 대한 주요 쟁점을 검토하고 이행상의 문제점에 대하여 분석하는 것을 목적으로 한다. FTA 원산지 규정은 물품의 국적을 결정하는 제 규정을 말한다. FTA 원산지 기준을 충족한 경우에만 특혜관세 혜택을 볼 수 있기 때문에, 원산지 규정에 대한 이해는 생산자, 수출자, 수입자 등 이해관계자들에게 매우 중요하다. 본고는 USMCA 자동차 분야 원산지 규정의 특징을 ① 역내 부가가치의 상향 조정, ② 역내산 철강 및 알루미늄의 사용 요건, ③ 노동가치 기준의 도입 등 3가지로 요약하였다. 본고는 노동가치라는 새로운 기준의 도입과 역내산 철강 및 알루미늄 사용 요건이 어떤 의미를 지니는지 검토하면서, 특히 FTA 이행과정에서 불거질 수 있는 쟁점들에 대하여 검토하였다. 한국은 USMCA 당사국은 아니지만, 자동차, 철강 등 분야에서 많은 한국의 기업들이 북미 지역을 주요 시장으로 삼고 있으며, 멕시코 등에 현지 생산시설을 운영하고 있는 경우가 많으므로 USMCA 원산지 규정에 대한 이해는 한국에게도 매우 중요하다.
