형사사건의 재판 전 회의제도는 현재 진행되고 있는 중국 형사사법제도의 개혁 가운데 중요한 부분의 하나이다. 형사사법 개혁의 주된 목적은 여러 가지 있을 수 있지만 재판을 중심으로 법정의 실효성을 제고하여 효율성이 보장되는 재판 전 회의 제도도 그중 하나라 할 수 있다. 물론 재판 전 회의제도의 도입에 대하여 긍정적인 부분만 있는 것은 아니다. 현재 중국의 형사사법 가운데 재판 전 회의제도는 관련법 률 개정의 소홀, 입법의 미비 등의 이유로 형사절차의 기능을 다하지 못하여 사법실 무에 어려움을 겪고 있다. 예를 들면 제도의 기능에 대한 규정이 불명확하고 처리해 야 할 사항이 분명하지 않으며 적용률이 낮아 절차상의 많은 문제가 제기되고 있다. 이러한 문제점을 인식하여 본 논문은 우선 영미법계와 대륙법계에서 오랜 발전을 거 쳐 공동으로 적용하고 있는 형사사건의 재판 전 관련 절차와 제도를 검토하기로 한 다. 다음으로 중국의 형사소송제도에 존재하고 있는 문제점을 분석하고, 이를 바탕으 로 형사사건의 재판 전 회의제도가 “여과기” 혹은 “방화벽”의 역할을 할 수 있는 방 안을 모색하고자 한다. 중국 형사사법에 있어 재판 전 회의제도는 이미 6년을 실행하였고, 그동안 최고 인민법원은 여러 번 관련 규정을 제정 또는 개정하여 지방법원이 실행 가능한 세칙 을 만들어 실시하도록 하였다, 하지만 아직도 절차에 있어서 규범화가 부족하여 형 사실무상 여전히 여러 문제를 나타내고 있다. 특히 형사사건에 있어 재판 과정의 지 연으로 너무나 많은 시간을 낭비하고 있다. 선진 국가에서 실행하고 있는 형사사건 의 간소화된 제도를 도입하면 문제의 해결에 도움이 될 것으로 본다. 구체적이고 합리적인 재판 전 회의제도는 피고인의 죄의 자백, 검사의 공소와 변 호인 변론 사이의 협상에 있어 좋은 조건을 마련해 주게 된다. 따라서 본 논문은 현 재 진행되고 있는 중국의 재판전 회의제도의 문제점을 지적하여 기존의 법률체계와 모순이 없도록 하는 연결의 역할이 무엇인지 제시하는 데 있다. 이러한 목적이 달성 되면 ‘지혜로운 법원’의 건설과 ‘사법 정보화의 제고’에도 도움이 될 수 있다고 본다.
