In accordance with Marriage Law of the People's Republic of China, marital property system consists of community property system of postnuptial income, the system of personal peculiar property, and contractual property system. China is a traditional country based on Confucian philosophy, which indicates that premarital agreements about husband-and-wife property goes against the national mood. Therefore, for a long time, its utilization rate is not satisfactory. In recent years, with the rapid development of China's economy,the property of husband and wife has been continuously increasing, coupled with the rise of divorce rate, there is a stronger individualism - oriented tendency to deal with property relations. Although the marital property relationship has the value and right of an independent individual, it also possesses the features and quality of a community. Marital property system, which takes these features into consideration, is introduced for reasonable and equal coordination of property relationship between husband and wife. This paper studies the current marital property system in a systematic way, reviews its use and existing problems, and proposes the countermeasures including the legislation theory about the marital property system.

현행 중국 혼인법은 부부재산제를 혼후소득공동재산제(婚後所得共同財産 制)와 개인특유재산제(個人特有財産制) 및 약정재산제의 3중(三重) 구조로 규정하고 있다. 중국은 유교철학에 바탕을 둔 전통국가로서 혼인 전에 부부재 산에 관해서 약정하는 것이 국민들의 정서에 반하는 일면이 있으므로 오랫동 안 활용도가 미흡한 실정이었다. 최근에 와서 중국경제의 비약적인 발전에 따 라서 부부재산이 늘어나고 게다가 이혼율이 상승하면서 개인주의적 취향에 의 해 재산관계를 처리하려는 경향이 날로 강해졌다. 부부의 재산관계는 독립된 인격체이면서도 공동체의 성격과 특징을 가지고 있다. 부부재산제는 이러한 특성을 감안해서 부부재산관계를 합리적으로 평등하게 조화시키기 위한 목적 으로부터 도입된 것이다. 본고에서는 현행 부부재산약정제도를 개괄적으로 검 토하고 그 이용실태 및 그에 대한 문제점을 살펴본 후 부부재산약정제도에 대 한 입법론을 포함한 개선방안을 제시해 보고자 한다.
