This study is the result of an in-depth analysis taking a close look whether the courts of United States followed the rules of evidence in the economic espionage trials. In order to make it in-depth, the author focused only one case where the defendant was Dongfan Greg Chung from 2009 to 2011, a naturalized citizen of U.S. from China in 1972. After a theoretical review of the rules of evidence in the first half of it, the author tried to logically explain that there have obviously been several infringements of them in the both district and circuit trials regarding this case in the second half of it. The main subject of the study is the appeal decision of the case, which is U.S. Court of Appeals, Ninth Circuit v. Dongfan Greg Chung, No.: 10-50074, 2011. Speaking of the content, the author's criticism of the defendant and the prosection's wrangling over the five rules of evidence in the criminal cases(beyond reasonable doubt, Brady Rule, Confrontation Clause, Abuse of discretion, Federal Sentencing Guideline) and the court's decision is unfolding. The significance of this study is as follows. First, this case is the only one in the United States where the defendant was convicted of economic espionage through the trials since the EEA was enacted in 1996 until 2013. Second, it is not found that prior studies in either domestic or U.S. have been conducted on this single case. Finally, domestic researchers have rarely discussed the rules of evidence of U.S. in the economic espionage case.

본 연구는 미국의 형사사건 법정증거주의 규칙들이 자국 내 산업스파이 재판에서 어떻게 적용되었는지를 심층 분석한 결과물이다. 저자는 심층 분석을 위해 첫째, 하나 의 사건만을 집중 연구대상으로 하였으며, 둘째, 연구 전반부에서 증거주의 규칙들에 대한 이론적 논의를 한 다음, 후반부에서 그 규칙들이 모두 이 사건 재판에서 제대로 지켜지지 않았음을 논리적으로 설명하고자 하였다. 주 연구대상은 미국에서 2011년 산업스파이로 유죄 확정된 동판 그렉 청(Dongfan Greg Chung) 사건의 항소심 판결문이며, 내용은 미국의 형사사건 5가지 증거주의 규 칙들(합리적 의심의 여지없는 입증, 피고인에게 유리한 증거 공개, 피고인에게 불리한 증인과 대질할 권리, 재량권 남용 표준, 연방양형기준)에 대한 이론 검토, 법정에서의 쟁점 및 결정 내용, 법원의 결정에 대한 저자의 비판 등이다. 본 연구의 의의는, 이 사건이 1996년 미국에서 산업스파이법(EEA)이 제정된 후 수 년 전 까지 정식재판을 거쳐 유죄로 확정된 유일한 사건이라는 점, 국․내외 선행연구들 에서 이 사건 단일건에 대해 연구한 사실이 발견되지 않는다는 점, 그동안 미국 증거주 의 규칙들에 대한 국내 연구가 산업스파이 사건과 관련하여 심층 논의된 경우가 많지 않다는 점 등에 있다.
