With the economic prosperity, social progress and the gradual improvement of people’s living standards, sports industry is increasingly playing an important role and position in a harmonious society. The current sports law is an important symbol of the legalization of sports and a milestone for the sports industry to step onto the track of rule of law, which plays an important role in the development of sports industry. However, China’s sports related laws and regulations are not perfect to a certain extent for the social and economic development. From the legislative purpose, legislative background, adjustment objects, administrative departments and social groups, introduced the relevant legal systems of the United States and Japan, and marked a detailed comparison and analysis with the relevant legislation and systems of China. Through these comparison and analysis, this paper expounds the main problems existing in China’s sports law, and draws on the useful experience of two countries. Finally, combined with the current situation of China’s sports legislation at this stage, it puts forward some suggestions for sports legislation, which provides reference for strengthening the construction of China’s sports legal system and improving China’s sports law system.

随着经济繁荣、 社会进步和人民生活水平逐步提高, 体育产业在和谐社会中日益显出重要作 用和地位。 现行体育法是体育法制化的重要标志, 也是体育产业走上法治轨道的里程碑, 对体育产 业的发展起着举足轻重的作用。 但中国的体育相关法律和法规对这社会和经济的发展, 在一定程度 上还不是很完善。 本文从立法目的、 立法背景、 调整对象、 行政部门和社会团体等方面,介绍美国和 日本相关法制的同时与中国的相关立法及制度进行了细致的比较和分析。 通过这些比较和分析阐 述了中国体育法中目前存在的主要问题, 并借鉴两个国家的有益经验, 最后结合中国现阶段体育立 法的现状, 提出了一些建议, 为加强中国体育法制建设、 完善中国体育法制度提供借鉴。

경제번영, 사회발전과 더불어 사람들의 생활수준이 나날이 향상함에 따라 스포츠 산업이 사회에서의 역할담당이 더욱더 뚜렷해지고 있다. 현행 스포츠 법은 스포츠 법제화의 중요한 표지이고 또한 스포츠 산업이 법치화의 궤도에 진입하는 이정표로 서 스포츠 산업의 발전을 좌우지 하고 있다. 스포츠법은 이러한 변화에 국가가 능동 적으로 대처할수 있도록 해야 하는 기본법으로 기능하고 있다. 하지만 중국의 현행 스포츠법은 일정한 정도에서 미흡한 점이 있기에 시급히 개정해 할 필요가 있다. 본 연구는 입법목적, 배경, 조정대상, 행정부문과 사회단체 등 면에서 미국과 일본의 스 포츠 관련 법제를 소개하였다. 이러한 비교분석을 통하여 중국의 현행 스포츠법이 존재하고 있는 문제점과 법리적 매카니즘들에 대해 검토한 후 중국의 현단계실정에 알맞는 스포츠 법의 개정안에 대해 개선방안을 지적하였다.
