Concerns about the growing number of ISD cases have become an anxiety due to the defeat from Dayani case. While our government has made a lot of efforts to prevent and respond to ISD, criticism has been raised over the lack of efficiency and consistency in practice. To effectively respond to ISD, systemic efforts such as establishing an expert pool, strengthening the government’s capacity and monitoring of recent investment disputes is necessary, and legal regulations that can support them systematically are also highly required. Countries that had experienced ISD began to establish ISD prevention and response systems early, but Korea only recently enacted government regulation on the prevention and response of international investment disputes’. However, the regulation contain some abstract content about the organization and work of the response group, and there are omissions to enhance the capabilities that are substantially required. Therefore, the tentatively named ‘Act on ISD Prevention and Response’ is necessary and an effective response system should be established to supplement the deficiencies of the current mandate and reflect the new demands. To cope with the growing number of ISD cases, the whole society will have to discuss effective and realistic measures, including legislation, in depth.

론스타 사건 이후 매년 증가하고 있는 ISD 사건에 대한 우려가 다야니 사건의 패소로 현실이 되었다. 그 동안 우리 정부에서는 ISD 사건들을 대응하기 위해 많은 노력들을 하 였으나, 체계적이고 실효적인 시스템 부재에 대한 비판이 제기되고 있다. ISD에 대한 실효 적인 대응을 위해서는 전문인력의 확보, 정부의 대응역량 강화, 투자분쟁모니터링 등의 체 계적인 시스템이 필요하고, 이를 제도적으로 뒷받침 해줄 수 있는 법규정이 필요하다. ISD 를 경험한 국가들은 일찍부터 ISD 예방 및 대응 시스템을 구축하기 시작하였으나, 우리는 최근에서야 ‘국제투자분쟁의 예방 및 대응에 관한 규정’을 제정·발령하였다. 그러나, 동 규정은 대응단의 조직 및 업무에 대해 다소 추상적인 내용들을 담고 있고, 실질적으로 필 요한 역량 강화를 위한 업무들이 누락되어 있다. 따라서, 가칭 ‘ISD 예방 및 대응에 관한 법률’이 필요하며, 현재 훈령의 부족한 부분을 보완하고 새로운 내용들을 반영하여 실효적 인 대응시스템을 구축하여야 할 것이다. 점점 증가하고 있는 ISD 사건의 대응을 위해 법 률의 제정을 포함한 실효적이고 현실적인 방안들에 대해 각계가 깊이 있게 논의해야 할 것이다.
