As a whole, it is said that the residents escaping from North Korea or North Korean refugees have trouble adjusting to South Korean society such as suffering criminal damages or committing illegal activities themselves, not only because of different legal systems and cultures between South and North Koreas but also of their ignorance of laws in South Korea. To identify these problems, this survey tries to evaluate the legal knowledge of North Korean refugees in checking the details of the legal knowledge on the crime damage and crime offence among North Korean refugees and analyzing the differences with South Korean in general. In addition, it tries to suggest how to improve legal education of North Korean refugees to enhance the understanding of their legal knowledge. In terms of survey, North Korean defectors who are over 19 and have stayed in South Korea were found to have a markedly low understanding compared to their South Korean counterparts. When it comes to Legal Consciousness related to criminal damage and crime occurrence, North Korean refugees showed the lowest-level consciousness of common sense regarding laws in the field of criminal judicature, and a huge gap in levels of understanding assault, bodily injury (including sexual assault), and domestic violence compared to South Koreans surveyed. In terms of fraud and narcotic crimes, however, over half of the North Korean refugees surveyed showed no different levels of consciousness compared with their South Korean counterparts. This survey has an implication that legal education should be provided to North Korean refugees in the form of regional settlement education for social adaptation.

북한이탈주민은 남한 사회와 북한 사회의 여러 가지 사회문화 적 환경의 차이 중에서, 특히 법체계나 법문화의 차이로 인해 범 죄피해를 경험하거나 범죄를 저지를 수 있다는 지적이 제기되어 왔다. 이러한 문제의식을 검토하기 위하여 이 논문에서는 북한이 탈주민들 사이에서 다발하는 범죄피해 및 범죄발생 관련 ‘법 관 련 지식’, 즉 ‘법지식’의 세부 내용을 확인하고 일반국민과의 차 이를 분석함으로써 북한이탈주민의 법지식 수준을 평가하였다. 또한 이를 통해 북한이탈주민의 법지식 수준을 고양시키기 위하 여 북한이탈주민을 위한 법교육 내용이 어떻게 개선되어야 하는 지를 제안하였다. 수도권에 거주하는 만19세 이상 북한이탈주민과 일반 국민을 대상으로 실시한 설문조사의 분석결과에 의하면, 북한이탈주민은 범죄피해 및 범죄발생 관련 법지식 수준이 일반 국민에 비하 여 현저하게 낮은 상태이다. 특히 북한이탈주민은 형사사법 분야 의 기초적인 법률상식, 폭행 및 상해(성폭력 포함)와 가정폭력 관련 법지식에서 일반 국민과 큰 차이를 보인다. 이에 비하여 사 기범죄와 마약범죄 관련 법지식은 상대적으로 일반국민과 큰 차 이를 보이지 않는다. 북한이탈주민이 법지식의 부족이나 법문화의 차이로 인해 발 생하는 범죄피해와 범죄발생을 감소시키기 위해서는 이들이 취 약한 법지식 수준을 향상시킬 수 있도록 거주지를 중심으로 지 역사회 적응교육의 일부로서 법교육의 기회가 보다 많이 제공되어야 한다.
