With forms of employment currently becoming various, it is more necessary than ever to apply the industrial accident compensation insurance to freelance workers in special employment types including platform workers as the number of them is increasing. The problem, however, is not readily solved as to who are to pay the insurance cost if the freelance workers in special employment types including platform workers when the industrial accident compensation insurance scheme is applied to them under the current scheme. This paper suggests the possibility of applying industrial accient compensation insurance scheme to the the freelance workers in special employment types, particularly the platform workers providing services through the platform acting as a work agent or a manager to provide service. For this, this paper examines first of all whether the platform business owner is really a business owner under the Industrial Accident Compensation Insurance Act who has responsibility to pay the insurance cost. This paper concluses the platform business owner is responsible to pay the insurance cost for the platform workers.

최근 다양해진 고용형태와 함께, 특히 플랫폼노동 종사자를 포함한 비전속적 특수형태근로종사자의 증가에 따른 산재보험제도 적용 필요성이 높아지고 있다. 그런데 현행 산재보험제도 하에서 플랫폼노동 종사자 등 비전속적 특수형태근로종사자들이 산재보험제도의 적용대상이 될 경우 산재보험료를 부담해야 하는 것은 누구인가에 대한 문제가 잘 해결되지 않고 있다. 이 글은 현행 산재보험제도 하에서 비전속적 특수형태근로종사자, 그 가운데에서도 플랫폼이 노동중개자 혹은 관리자가 되어 노무제공이 이루어지고 있는 사업에서 노무를 제공하는 플랫폼노동 종사자에 대한 산재보험제도 적용 가능성을 말해보고자 하였다. 이를 위해 우선 산재보험법상 사업주의 의미에 대하여 검토한 후, 플랫폼사업주가 산재보험법상 보험료 책임을 지는 사업주로서의 의미를 갖는지 여부에 대하여 검토하였다. 결론적으로 플랫폼노동 종사자들에 대하여 플랫폼 사업주가 보험료책임을 져야 한다고 보았다.
