It is a transitional period when the evaluation of blockchain technology is mixed. This study is based on the presumption that blockchain is a challenging technology that helps to change the distribution structure and flow of the contents industry more fairly and efficiently as a content-friendly technology, and gives a clue or alternative to solving various problems facing the contents copyright industry. Looking at the contact point between the blockchain technology and the copyright system as a challenging technology that can provide and examine the necessity and usefulness of its use. To this end, we first looked at the content-friendly technical features and functions of the blockchain, pointed out the problems of the current copyright industry ecosystem and its circulation structure, and then looked for possibilities and contact points where the blockchain technology would supplement or emerge as an alternative. Blockchain aims at Immutable, Transparent, Decentralized, and Consensus based on Encrypted, and it is utilized through Programmable like Smart Contract. It is a technology that can implement a service that expands the scope. Considering these characteristics, we reviewed the use of records on the blockchain to improve the creative ecosystem of the work, to verify the authors, and to verify the copyright generation system, and to examine the possibility of forming and replacing the international copyright registration system. Furthermore, the blockchain has an effect on the current copyright management system, and we have explored the possibility of an alternative to the blockchain that can overcome the limitations and problems of the current digital copyright management system (DRM), and also have an effect on the centralized copyright management system. In addition, we reviewed the possibility of the blockchain as a means to solve the problems of orphan works and using the liquidation of the copyrighted assets by blockchain as a asset-based tokens. Lastly, with regard to the security and tracking functions of the blockchain, we examined the blockchain as a means to strengthen copyright protection and rights relief. In other words, the usefulness as evidence and the advantages of dispute resolution through prevention of infringement are the examples.

블록체인 기술의 가능성에 대한 평가가 엇갈리고 있는 과도기적 시기이다. 이 연구는 블록체인 기술과 서비스의 전망을 콘텐츠 친화 적인 기술로서 콘텐츠산업의 유통구조와 흐름을 보다 공정하고 효율 적으로 바꿀 수 있게 도와주며 콘텐츠저작권 산업이 당면한 여러 가 지 문제점을 해결해 줄 수 있는 실마리나 대안을 제공할 수 있는 도 전적 기술로 보고 블록체인 기술과 저작권 제도 간의 접점을 모색해 보면서 그 활용의 필요성과 유용성을 검토해 본 것이다. 이를 위해 우선 블록체인의 콘텐츠 친화적 기술적 특징과 작용을 살펴보고, 현 행 저작권산업 생태계 및 그 순환 구조상의 문제점을 짚어본 후, 블 록체인 기술이 이를 보충하거나 대안으로 등장할 가능성과 접점을 찾아보았다. 블록체인은 “암호화를 기반으로 불가역(Immutable), 투명 성(Transparent), 탈중앙화(Distributed), 합의(Consensus)를 지향하며 스 마트계약(Smart Contract)과 같이 프로그램화를 통해 활용 범위를 확 장”하는 서비스를 구현할 수 있는 기술이다. 이러한 특성을 감안하여 블록체인에의 기록 활용이 저작물 창작 생태계의 개선과 저작자 확 인과 저작권 발생의 확인체제에 유용하게 작용하는 점과 국제 저작 권 등록제도 형성 및 대체 가능성에 대해서도 검토해 보았다. 나아가 블록체인은 현행 저작권 관리체제에 미치는 영향을 미치게 되는데, 현행 디지털저작권 관리체제(DRM)의 한계와 문제점을 극복 할 수 있는 블록체인의 대안가능성을 모색해 보았고, 저작권 집중관 리체제에 미치는 영향도 점검해 보았다. 아울러 고아저작물의 문제 해결 수단으로서 블록체인과 자산기반 토큰에 의한 저작권의 상품 유동화 활용가능성에 대해서도 검토해 보았다. 마지막으로 블록체인 의 보안 및 추적기능에 착안해 저작권 보호와 권리구제 강화수단으 로서의 블록체인에 대해 점검해 보았다. 즉, 증거확보 수단으로의 유 용성, 사전 침해 예방을 통한 분쟁 해결의 장점 등이 이에 해당한다.
