As the National Assembly passed the “Law to Adjust the Investigation power of the Prosecutors and the Police" on January 13, 2020, the police became a investigation agency with the primary investigative power on all cases. However, the prosecutor's investigation control power has been abolished, and effective democratic control measures have been urgently requested due to concerns over abuse of authority or human rights violations following the police's enforcement of authority. In this paper, the conclusion was drawn by reviewing three things: a new police ombudsman as an external and democratic control measure, a plan to utilize the existing National Rights Commission or the National Human Rights Commission, and a measure to grant the police committee the ombudsman function. That is to say, the paper concluded that the police committee's performance of Ombudsman's function could satisfy both justifiable and feasible. Based on this conclusion, it proposed that police ombudsman be installed and operated within the police committee to ensure independence and political neutrality of the police committee. And in that case, the division of duties with National Rights Commission or the National Human Rights Commission, the prosecution service, the granting of necessary powers and the procedure for handling civil complaints were discussed in detail.

검경수사권 조정 이후 경찰권의 강화에 따른 권한남용이나 인권침해의 우려로 실효 적인 민주적 통제방안의 마련이 절실히 요청되고 있다. 이 논문에서는 경찰에 대한 외 부적․민주적 통제방안으로서 경찰위원회를 개혁하고, 경찰옴부즈만 설치와 관련하여 새로이 기관을 신설하는 방안, 기존의 국민권익위원회나 국가인권위원회를 활용하는 방안, 경찰위원회에 옴부즈만 기능을 부여하는 방안 등 3가지를 검토하여 결론을 도출 하였다. 구체적으로 경찰위원회의 독립성과 정치적 중립성을 확보하기 위해 경찰개혁위원회 가 권고한 ‘경찰위원회 실질화 방안’이 타당하다고 평가하고, 그 내용을 실현한다는 전 제 하에 경찰위원회 내에 경찰옴부즈만을 설치해 운용할 것을 제안하였다. 그리고 그 경우에 필요한 국민권익위, 국가인권위, 검찰과의 민원처리 업무의 분장, 필요한 권한 의 부여와 민원처리절차 등을 구체적으로 논하였다. 이러한 개혁방안의 모색이 경찰위 원회가 경찰권을 민주적으로 통제할 수 있는 기능과 위상을 확보하고, 경찰신뢰를 제고 하는데 기여할 수 있기를 기대한다.
