The recent popularity of mobility services using smart phones has brought a revolution in the passenger transportation. The emergence of a platform-based transport company based on such a network presents problems as much as changes in the transportation field. In particular, passenger transport services such as Uber, Didi Chuxing, Grab, Car Pool, Tada, and Call Bus have brought controversies. Underlying this controversy is the oversupply of taxis. The taxi industry is already in a poor condition, and the emergence of new platform transport companies that overlap the taxi business bring more problems in taxi industry. It is inevitable that there will be conflicts between them. It becomes an issue not only in Korea but also in other countries around the world. In the midst of this, Waymo, a subsidiary of Google, the world's largest internet company, began its taxi service using the self-driving vehicle in Phoenix, Arizona, on December 5, 2018. This is the first paid service using the self-driving car. The destination of the passenger transportation service by a platform will be self-driving vehicles. The ride sharing platform market by platform transport companies continues growing globally. Despite of controversies regarding legitimacy, ride sharing platform services have been settled abroad in the US, China, Malaysia, and India. Korea will not be able to go against the global trend. In the countries where platform passenger transport companies are operating, there were controversies over driver qualifications, vehicle operation conditions, insurance liability, tax related issues, and labor issues since the launch of the transport service, but the scope of business has continued expanding. However, in Korea, the platform transport company is still not in place. It is somewhere between legal and illegal. It is necessary to adopt a negative method by implementing first and then fixing detailed standards one by one later. Passenger transportation of platform companies, which is currently tried, can be the seed of future transportation business. Although there is a fierce combat between the platform transport company and the taxi industry, the new world is already in our sight. What we should do is a wise reaction. In addition to Uber, which was a global issue, new transportation services will continue to come. In order to minimize social conflicts and unnecessary costs, it is necessary to hurry up to have social, legal and institutional measures. In this paper, the trend of law related to the platform transport companies that are currently in operation will be identified and then passenger transport regulations will be investigated.

최근 대두되고 있는 스마트 폰을 이용한 모빌리티 서비스의 활성화는 여객운송에 혁명을 가져왔다. 이와 같은 네트워크를 기반으로 한 플랫폼운송기업의 등장은 변화를 가져온 만큼이 나 문제점을 드러내고 있다. 특히 플랫폼을 이용한 우버, 디디추싱, 그랩, 카풀, 타다, 콜버스 등의 여객운송 서비스는 많을 논란을 불러왔고, 그 논쟁은 아직도 계속되고 있다. 이러한 논란의 바탕에는 택시의 초과공급이 있다. 택시업계가 이미 열악한 환경인데 택시사 업과 영역이 겹치는 새로운 플랫폼운송기업이 속속 출현하고 있기 때문이다. 업계 간의 영역 다툼이 불가피할 것으로 보인다. 이는 우리나라뿐만이 아니라 전세계적으로 벌어지고 있는 현 상이다. 불법 논란에도 불구하고 미국, 중국, 말레이시아, 인도 등 해외에서는 택시, 카풀 등 승차공 유 서비스가 안정적으로 정착했고, 우리나라도 세계적 추세를 거스를 수는 없을 것이다. 플랫 폼여객운송기업을 운영 중인 이들 국가에서도 운송 서비스를 출시한 이후 운전자 자격, 차량 운행 조건, 보험책임, 세금관계, 근로문제 등의 논란이 있었지만 그 사업영역을 계속해서 넓혀 가고 있다. 그런데 우리나라에서는 아직도 플랫폼운송기업에 대한 정립조차 하지 못하고 있는 실정이고, 합법과 불법 사이에서 갈피를 잡지 못하고 있다. 이러한 가운데 세계 최대 인터넷 기업인 구글의 자율주행차 계열사인 웨이모(Waymo)가 2018년 12월 5일 미국 애리조나 피닉 스시에서 자율주행 택시 서비스를 시작했다. 유료 서비스를 하는 자율주행차는 처음이다. 플랫 폼에 의한 여객운송의 종착지는 자율주행차일 것이다. 일단 시행하고 세부 기준을 하나씩 마 련해가는 네가티브 방식을 도입 필요가 있다고 본다. 현재 벌어지고 있는 플랫폼기업의 여객운송은 미래 운송사업의 씨앗이다. 플랫폼운송기업과 택시업계가 생존을 건 치열한 영역다툼을 하고 있지만 이미 새로운 세계는 우리들의 눈앞에 있다. 현명한 대처가 필요한 부분이다. 세계적으로 문제가 된 우버뿐 아니라 앞으로도 새로운 운송서비스는 지속적으로 나타나게 될 것이다. 사회적 갈등이나 불필요한 비용을 최소화하기 위해서라도 사회적ž법률적ž제도적 정비를 서둘러야 할 것으로 보인다. 본 논문에서는 현재 운영되고 있는 플랫폼운송기업의 법률적 동향을 살펴본 다음 여객운송 규제를 알아보도록 한다.
