This research aims to analyze the characteristics and limitations in deliberating objectivity and provide basic data for the fake news identification standard. This is done through an analysis of the factors in determining whether broadcasting news violates the objectivity article in the Broadcasting Deliberation Regulation and in adjusting the sanction for violations against the Korea Communications Standards Commission (KCSC). The results show the tendency for low-level sanctions, such as administrative guidance, and media and program-specific discriminative deliberation. In determining objectivity article violations, there are content factors—such as accuracy, factuality, exaggerations, and expression distortions—and behavioral factors—such as pre and post actions to maintain objectivity, data use inadequacy, and source citations. In adjusting the sanctions for violations in the final decision stage, adequate production staff action, fairness with similar deliberation cases, simple mistakes, the program’s characteristics and nature, and overall context and intent are considered.

방송보도 심의에서 고려되는 객관성 조항위반 판단기준과 위반사례에 대한 최종 제재수위의 경중을 판단하는 요소를 분석함으로써, 객관성 심 의결정 논리의 특징과 한계를 파악하고 이를 토대로 가짜뉴스의 판단기 준을 모색할 수 있는 기초자료를 제공하는 것이 본 연구의 목적이다. 연 구 결과, 객관성 조항위반 심의에서 제재유형이 대부분 행정지도로 제재 수위가 낮은 경향을 보였고, 매체별, 프로그램 유형별 차별적 심의가 이 루어지고 있는 것으로 나타났다. 심의결정에서 적용되었던 판단기준은 불 명확성, 사실성, 표현의 과장과 왜곡과 같은 내용 차원과 객관성을 기하 기 위한 사전 사후 조치, 자료사용의 부적절, 출처표시 등과 같은 형식 차원으로 분류되었다. 또 위반사례에 대한 최종 심의결정에서 방송제작진 의 적절한 조치, 위반정보 및 유사 심의사례와의 형평성, 의도성 없는 단 순 실수, 프로그램의 특성이나 성격, 그리고 전반적인 맥락과 취지 등이 제재수위를 조절하는 요소로 작용하고 있었다.
