Regulating hate speech is a conflict between freedom of expression and freedom from discrimination. This article examines administrative, legislative, and judicial situations as well as legal issues regarding the hate speech regulation in Korea. The analysis found that the administrative regulation of hate speech is being implemented in various fields, and online expressions are being massively deleted on an inconsistent and unprofessional basis. Judicially, it is not easy for the court to impose legal punishment on hate expressions toward target groups under the current law. Thus, there is a regulatory vacuum in hate speech. With regard to legislation, the National Assembly acknowledges the need to regulate hate speech, but it is not clear which actions will be regulated, and target groups that should be protected are too broad. As a result, it is not easy to revise or enact laws. Regulating hate speech impose difficult problems in the legislative and judicial aspects, but content regulations by administrative agencies are easily implemented without clear standards. Finally, this article presented the need for a regulation (justified regulatory purpose), a target group (what group to protect), a regulatory method (how to regulate), and a regulatory subject (who will regulate) as the legal issues of hate speech.

혐오표현의 규제는 누구나 누려야 하는 표현의 자유와 차별받지 않을 자유 간의 충돌 문제이다. 본고는 혐오표현 규제에 대해 행정적, 사법적, 입법적 현황과 특성을 분석한다. 분석결과 국내에서는 혐오표현에 대한 행정적 규제가 광범위하게 이루어지고 있으며 비전문적, 비일관적 기준 아래 인터넷 표현물이 자의적으로 삭제되고 있었다. 사법적으로는 현행 법률 체제에서 법원이 특정집단을 향한 혐오표현에 대해 법적 제재를 하 기 쉽지 않기 때문에 규제공백이 발생하고 있다. 입법적으로는 혐오표현 에 대한 규제 필요성은 감지되고 있으나 법률안에서 보호하고자 하는 목 표집단이 광범위하고 규제행위도 명확하지 않았다. 그러다보니 법률 개정 이 쉽지 않다. 결국 혐오표현 규제는 입법과 사법적 측면에서 어려움을 겪고 있는 가운데 행정규제 기관에 의한 자의적인 심의와 제재는 손쉽게 이루어지는 비정상적인 상황이다. 결론적으로 혐오표현의 법적 쟁점으로 규제의 필요성(규제목적의 정당성), 목표집단과 규제대상, 규제방식과 규 제주체에 대한 정책적 제언을 담았다.
