This paper examines the question of what fake news is and how far it should be viewed as such. It critically reviewed the relevance of the concept of fake news, its condition, and the scope that contemporary researchers have presented. Based on this, the researchers discussed the meaning and validity of fake news concerning its legal, journalistic, technical, political, and social aspects. First, it was found that, after the researchers reviewed the conceptual validity of fake news, action should be taken to distinguish fake news from misinformation. Next, it was proposed that the falsity, intention, and formality of information should be specially considered as conceptual conditions for the establishment of fake news. Third, it suggested that regulation of fake news should be minimized when discussing the freedom of expression. Fourth, the research identified fake news as a “political communication phenomenon” which operates on the political and social environment of conflict and ideological confrontation. Fifth, it was determined that fake news exhibits a pattern of group polarization through psychological mechanisms, such as confirmation bias, negativity bias, selective interpretation. The study focused its discussion of the concept and scope of fake news on the Korean political and social environment.

이 글은 가짜뉴스는 무엇이며, 또 어디까지를 가짜뉴스로 볼 것인가에 대한 문제의식에서 출발했다. 이에 이 글은 연구자들이 지금까지 제시해 온 가짜뉴스라는 용칭, 개념, 그리고 범위의 적합성에 대해 비판적으로 검토했다. 이를 토대로 법률적, 저널리즘적, 기술적, 정치사회적 관점에서 가짜뉴스의 의미와 타당성을 통합적으로 논의해 보았다. 논의 결과를 정 리하면 다음과 같다. 첫째는 가짜뉴스의 개념적 타당성을 검토하고, 이를 허위정보와 구분할 필요가 있다는 점을 제안했다. 둘째 가짜뉴스가 성립 되기 위한 개념적 조건으로 정보의 허위성, 의도성, 형식성이 특별히 고 려되어야 한다는 점을 제안했다. 셋째는 가짜뉴스의 규제는 표현의 자유 권 차원에서 최소화되어야 한다는 점을 제안했다. 넷째는 가짜뉴스를 정 파적 갈등과, 이념적 대립이라는 정치사회적 토양위에서 작동하는 ‘정치 적 커뮤니케이션 현상’으로 파악했다. 다섯째는 가짜뉴스는 확증 편향성, 부정적 편향성, 그리고 동조화 폭포현상과 같은 심리적 기제를 통해 집단 극단화되는 양상을 보인다는 점을 지적했다. 가짜뉴스의 개념과 범위를 한국 정치사회 환경과 관련지어 토론했다.
