One of the current issues in Korea is the realization of social value. The realization of social value is expanding from the public sector to the private sector. There are 13 types of social value in the Social Value Act, but 13 types of social value are not applied to the Condominium Buildings Act. Among, the social value type that should be the most central in relation to the Condominium Buildings Act should be selected. Through such selection, the system improvement of the Condominium Buildings Act should be reviewed. In other words, social values that are deeply related to the Condominium Buildings Act include human rights, safety, participation, and community. In the end, the Social Value Law and the Condominium Buildings Act have a certain degree of relationship. It is necessary to regulate the purpose clause for human rights based on social value and to strengthen public regulations for safety. In addition, for participation, the direction of the system improvement of the Condominium Buildings Act for strengthening the decision-making structure and improving the collective building management system should be set.

현재 우리나라의 이슈 중의 하나는 사회적 가치 실현이다. 사회적 가치 실현은 공공분야에서 민간영역으로까지 확대되고 있다. 결국, 사회적 가치는 사회 모든 영역에서 공공의 이익과 공동체 발전에 기여하는 가치이다. 「사회적 가치법(안)」상의 사회적 가치 유형은 총 13가지가 있으 나, 「집합건물법」상에 위의 13가지의 사회적 가치 유형이 모두 적용 되는 것이 아니라, 그 중 「집합건물법」과 관련하여 가장 중심이 되 어야 하는 사회적 가치 유형을 선정하여야 할 것이다. 이러한 선정을 거쳐 「집합건물법」의 제도개선을 검토하여야 한다. 즉, 「집합건물 법」과 관계가 깊은 사회적 가치는 인권, 안전, 참여, 공동체 등이 있 다. 결국 「사회적 가치법(안)」과 「집합건물법」은 일정한 정도 관 계가 있다. 사회적 가치를 기준으로 하여 인권에 대해서는 목적조항 신설 방안, 안전에 대해서는 공적 규제 강화, 참여에 대해서는 의사결정 구조의 강화, 공동체에 대해서는 집합건물 관리체계 개선에 대한 「집합건물 법」의 제도개선의 방향성을 설정할 수 있다.
