Communications frauds still put ordinary people in trouble. They have become even more difficult problems as Chinese individuals get involved in such crimes as foreigners. Such crimes are committed in an organized manner with roles divided among data processing, implementation, and wire transfer under the overall supervision of the person in charge. People across various age groups fall victims to such crimes, suffering a loss. Communication fraud crimes are committed in an organized way with no match between the place of action and the place of outcome, having the nature of international and organized crimes. As their methods of operation and organizational compositions reflect the social situations, they change fast. Victims are in a passive position of being deceived in a one-sided manner. These characteristics should be taken into consideration as important elements in the interpretation and application of crime elements and the reaction to and prevention of crimes. In South Korea, there are procedures in place to protect victims based on the application of Special Act on the Prevention of Loss Caused by Telecommunication-Based Financial Fraud and Refund for Loss. As they apply the crime of organizing a criminal group to such crimes in addition to frauds under criminal law, they take an intuitive approach to the true nature of such events. The sentencing criteria have been arranged to propose heavier recommended sentences and specific sentencing factors. Foreigners involved in such a crime can be subjected to compulsory eviction. In China, they do the practical business regarding communication fraud crimes to which frauds are applied under the law in a way that they make a severe sentence for such crimes and do judicial interpretations to deal with some protective measures for victims, as well. In the aspect of policies, they tend to emphasize preventive measures for victims as well as strong criminal punishments, being able to make flexible and agile reactions. South Korea and China need to push forward together cooperation in judicial justice, reinforced redemption of profit from crimes, sharing of know-how, and policy measures to improve the awareness of South Korean and Chinese people according to their joint strategies based on mutual trust.

전기통신금융사기는 여전히 서민들을 괴롭히고 있고, 외국인인 중국인까지 범행에 가담하여 더욱 어려운 문제가 되고 있다. 총책과 전산팀, 실행행위자와 송금책 등 역할 분담이 나뉘어, 총책의 전반적인 사태 지배 아래 조직적으로 이루어지는 범행으로 인해 다양한 연령층에서 피해가 발생하고 있다. 전기통신금융사기범죄는 주로 행위지와 결과발생지가 일치하지 않는 조직적 범행으로 국제범죄성과 조직범죄성을 가지며, 범행 수법과 조직구성이 사회 상 황을 반영해 빠르게 변하는 성질을 갖고 있다. 한편 피해자는 일방적으로 속는 수동적 위치에 있다. 이러한 특징들은 범죄구성요건의 해석·적용과 범죄대응 및 예방에 중요한 요소로 고려되어야 한다. 한국은 통신사기피해환급법을 적용하여 피해자보호절차까지 마련하고 있고, 형법상 사기죄 외에 범죄단체조직죄를 적용하여 사건의 실체에 직관적으로 접 근하고 있다. 또한 양형기준을 정비하여 좀 더 높은 권고형량과 구체적인 양형 인자를 제시하고 있고, 범행에 가담한 외국인은 강제퇴거 대상자로 될 수 있는 상황이다. 반면 중국은 법령상 사기죄가 적용되는 조직범죄일 뿐이지만, 전기통신금융 사기범행에 중형을 선고하고 일부 피해자보호조치를 함께 다루는 취지의 사법 해석을 통해 실무를 운영하고 있는 것으로 보인다. 정책적 측면에서는 강력한 형사처벌과 피해자들에 의한 예방조치를 강조하는 경향을 보이고 있어 유연하 고 기민한 대응이 가능하다. 한·중 양국은 신뢰에 기반한 공동구축 전략에 의한 형사사법공조와 범죄수 익환수 강화, 노하우 공유 등 합동 대책, 양국민들의 인식 개선을 위한 정책적 조치 등을 함께 추진하여야 한다.
