Since the 1990s, the software industry has seen remarkable growth with various excellent information protection products being released under the support of the government's policy to support venture companies. As a result, Korea has grown into a country where domestic companies are in charge of information security on national information, corporate information and personal information. Along with the rapid development of global information and communication technologies in advanced countries such as the United States and Japan, Excellent human resources flowing into our information protection industry are being leaked to overseas information industry. Also, the technology that has been accumulating is in danger of being laid off. Recently, information security companies are complacent in the small but stable profit-taking market. As a result, domestic companies preference for the domestic market has led to excessive competition for bleeding, leading to side effects such as low-cost orders and the succession of large companies. At a time when the information protection industry is heading for excessive competition in Korea, it is very necessary to improve the legal system for fostering the policy base for overseas exports of information protection products. This institutional-based creation is not short-lived on the corporate side. At the national level, the establishment of a legal, administrative and financial support system for the entire information protection industry is very important. In accordance with the need for such discussions, this research aims to present legal and institutional improvement measures that enable our information security companies to develop excellent information protection products optimized in various environments in the global information market and to respond to changes in ICT market environment for overseas advancement.

1990년대 이후 정부의 벤처기업 지원정책의 시행에 힘입어 우수한 정보보호제 품이 다양하게 출시되면서 정보보안소프트웨어산업 전반에서 괄목할만한 성장을 이루어 왔으며, 그 결과 우리나라는 국내기업이 국가정보, 기업정보, 개인정보에 대한 정보보안을 자체적으로 담당하는 국가로 성장해왔다. 최근 미국, 일본 등 선 진국에서의 글로벌 정보보호산업(IPI)의 급속한 발달의 원인으로 우리의 정보보호 산업은 상당히 위축되어 왔으며 그에 따른 정보보호산업분야 인재의 해외기업이나 타 산업으로의 유출은 정보보호관련 산업에서 심각한 손실을 초래했다. 글로벌 정보보호산업의 과도한 경쟁은 우리의 정보보호산업이 국내외적으로 상 당히 어려움에 처해 있음을 대변해주고 있다. 그동안 정보보호산업 분야에서의 해 외기업으로의 인재유출은 국내 정보보호기술의 해외유출이나 경쟁력 저하로 이어 졌다. 국내 정보보호제품을 생산하는 기업들은 국제적 경쟁력을 상실하여 국내시장에서 안주한 결과 국내에서의 과도한 출혈경쟁현상으로 나타나고 있다. 정보보 호산업은 정보통신기술(ICT)분야에 비하여 기술향상과 글로벌 경쟁력확보가 상당 히 더딘 분야로서 한번 경쟁력을 상실한 정보보호산업분야의 경쟁력확보는 국가차 원의 적극적 육성과 지원이 필요한 분야이다. 국내 정보보호산업의 경쟁력을 확대 하고, 정보보호산업의 해외진출을 확대하기 위해서는 ｢정보보호산업의 진흥에 관 한 법률｣에 근거한 정부의 적극적 투자로서 제4차 산업혁명시대 및 인공지능(AI) 시대 차세대 성장엔진으로서 정책을 추진할 필요가 있다. 정부의 정보보호산업 관련 법제의 규제완화를 통한 정보통신기술(ICT)분야의 발전에 상응하는 산업기반의 조성과 투자확대가 필요하다. 최근 정보보호산업이 국제적 경쟁력을 상실한 상황에서 국내시장에만 머무르고 있는 현실에서 우리한국 의 강점인 정보통신기술과 정보보호기업의 제휴를 통한 해외진출을 위한 정책적 기반마련을 위한 법제도적 개선 또한 매우 필요한 시점이다. 본 연구에서는 우리의 정보보호기업이 글로벌 정보시장의 다양한 환경에서 최 적화된 우수한 정보보호제품을 개발하고 해외진출을 위한 정보보호산업 시장환경 의 변화에 대응할 수 있도록 정책적 지원이 가능한 법제도적 개선방안을 제시하고자 한다.
