The purpose of this paper is to present the role of the Judicial Commission by the General Assembly[JCGA] based on evaluation from a point of a law-theological perspective about recent trends of the State Court’s Civil Cases on the Church. The role of JCGA depends on how it accept characteristics of the law. In response, I reviewed a lawtheological assessment of the recent trends of civil cases except the criminal cases and administrative cases of the nation, centered on the four cases: The effectiveness of the decision by JCGA, the reality of the church, the right to release the Pastoral office, and the church schism and property. This article suggests the following roles of JCGA. First of all, JCGA must be faithful to judgment of law as the appellate court even though it is beyond the legal system. Secondly, JCGA should play a prudent role in revealing the theological reality of the church. Third, the trial of JCGA should faithfully play the role of implementing the theological purposiveness of the law in history. Finally, JCGA must play a role to open the reception of law through the preservation and public announcement of court records.

이 논문의 목적은 국가 법원의 교회 민사 사건에 대한 최근 동향을 법적-신학적 관점에서 평가하고 교단 총회 재판국의 역할을 제시하는 데 있다. 총회 재판국의 역할은 법의 총체성을 바탕으로 법의 계수성과 법신학적 합목적성을 어떻게 받아들이느냐에 달려 있다. 이에 대해 필 자는 최근 국가 법원의 민사 사건의 경향을 네 분야를 중심으로 법신학 적 평가를 검토하였다. 즉, 총회 재판국 판결의 효력에 대한 판례와 평 가, 교회의 실체에 대한 판례와 평가, 목사 해제권에 대한 법신학적 평 가, 교회 분열 및 교회 재산에 대한 판례와 평가 등이다. 여기에서 얻은 결론으로 필자는 국가 법원과 총회 재판국의 역할을 제시하였다. 첫째 로 최종심으로서 총회재판국은 상고심으로서 법률심에 충실하여야 한 다. 둘째, 교회의 신학적 실체를 잘 드러내는 역할을 신중하게 해야 한 다. 셋째, 법의 신학적 합목적성을 구현하는 역할을 성실하게 수행하여 야 한다. 마지막으로 교회재판 기록의 보존 및 공시를 통해 법의 계수 성을 열어주는 역할을 해야 한다.
