This study analyzed the current status of the rights of children of incarcerated parents and related policies. The goal of the study is to ensure that basic rights are guaranteed for children with incarcerated parents whose rights aren’t protected due to the status of the parents. In this study, the rights of children with incarcerated parents are defined as the Right to Survival, Right to Development, Right to Protection, Right to Participation, and Right to Maintain Personal Relations and Direct Contact with both Parents on a Regular Basis. These definitions are based on the rights of children according to the ‘UN Convention on the Rights of the Child.’ For this study, official statistics and previous studies were re-analyzed and it concluded by providing possible improvements to current correctional policy and related systems. The main findings are as follows. First, on a daily basis, the average number of children of incarcerated parents is 22,000. On an annual basis, the amount of the children is around 32,000. Among these population approximately 18,000 children are new persons. Meanwhile, when looking at the child’s basic rights depending on the parent’s incarceration period, the child’s Right to Survival was most threatened during the beginning stages of incarceration. The child’s Right to Development was affecting children long-term when they experienced psychological damage and the child’s Right to Protection could not be provided by their parents if the parent’s incarceration period lengthened. The child’s right to Maintain Personal Relations and Direct Contact with both Parents on a Regular Basis grew as the parent’s duration of incarceration lengthened. Second, in reviewing current incarceration institutions, the study reviewed the current status of related laws and visitation programs as well as provided ways to vitalize the Right to Maintain Personal Relations and Direct Contact with both Parents on a Regular Basis for children with incarcerated parents. Third, for related policies, the study discusses the recent ‘Embracement National Child Policy’ as well as legal, political, and human rights perspectives in analyzing the social status of children with incarcerated parents. It also discusses the limitations of related policies. Finally, to ensure the rights of children with incarcerated parents, the study suggests ‘approaches centered on the child’ and ‘increased responsibility of the nation’ as the fundamental support principle. The study also suggests ways to improve incarceration institutions and related policies per basic rights(Right to Survival, Right to Development, Right to Protection, Right to Participation, Right to Maintain Personal Relations and Direct Contact with both Parents on a Regular Basis).

본 연구는 부모의 수용으로 인해 아동의 권리를 보호받지 못 하고 있는 수용자자녀들에게도 기본적 권리들이 보장될 수 있기 를 희망하면서, 수용자자녀들의 권리현황과 관련정책을 분석하 였다. 본 연구에서 수용자자녀들의 권리는 ‘UN 아동권리협약’ (UN Convention on the Rights of the Child)에 명시된 아동의 권리들 중에서 생존권, 발달권, 보호권, 참여권, 면접권을 기본 권리로 정의하였다. 연구를 위해 공식통계와 기존 연구 자료들을 재분석하였고, 이를 통해 수용자자녀들의 상황과 권리보장을 위 한 교정정책 및 관련제도의 개선방안을 제시하였다. 주된 발견사 항은 다음과 같다. 먼저 수용자자녀들의 인구규모는 일일평균 22,000여명이 상 존하고, 연간은 32,000여명인데 그 중 18,000여 명은 매년 새롭 게 발생하는 인구이다. 한편 부모의 수용기간에 따른 자녀들의 기본권 상황을 분석한 결과, 생존권은 수용초기의 자녀들에게 가 장 위기적이었고, 발달권은 심리적 손상을 경험한 모든 자녀들에 게 장기적으로 영향을 주게 되며, 보호권은 부모의 수용이 길어 질수록 친생부모의 보호를 받지 못하게 되고, 참여권과 면접권은 부모의 수용기간이 경과함에 따라 해당하는 인구가 증가하고 있 었다. 둘째, 교정제도 현황분석에서는 관련법과 접견프로그램들 의 실태파악과 함께 수용자자녀들의 면접권 활성화를 위한 개선 방안을 제시하였다. 셋째, 관련정책들로는 최근의 ‘포용국가아동 정책’을 포함하여 법률적, 정책적, 인권적인 측면에서 수용자자 녀들의 사회적 상황을 살펴보고 한계점을 논의하였다. 마지막으 로 수용자자녀 권리보장 방안으로 ‘자녀 중심으로 접근할 것’과 ‘국가의 책임강화’를 지원원칙으로 제시함과 아울러 기본 권리 (생존권, 발달권, 보호권, 참여권, 면접권)별로 교정제도와 관련 정책들의 개선방안을 제안하였다.
