As it was questioned about whether people in the correctional facilities can exercise their right to defense when they are investigated or tried, the purpose of this study is to investigate and resolve the problems or difficulties of our criminal justice system. Under the drei-instanzen-system in Korea, the Constitutional Charter guarantees with the basic human rights and the principle of ‘presumption of innocence’, until the trial at the Supreme Court is completely over, And the most important priority for the detainees is to prove their innocence during detention and to prepare for their trial. In this regard, in order to compare the domestic standards with the international standards relating the right to defense during detention, this study conducted interviews with 7 participants who were detained at the correctional facilities at least 4 months. The qualitative analysis of the interviews revealed that there are compelling difficulties and limitations to ensure that detainees have the relevant legal defense rights. The real-life experiences from our participants were discussed and the approach we should consider to promote the status of our correctional facilities was proposed.

본 연구는 미결수용자의 교정시설 내 처우의 문제점을 알아보 고자 하였다. 그중에서도 특히, 미결수용자가 수사나 재판을 받 을 때 충분히 방어권 행사를 할 수 있는지에 대해 의문을 가졌 다. 본 연구의 목적은 현재 교정시설 내에서 이와 관련한 문제점 에 대해 알아보고 그 개선 방안을 찾기 위한 것이다. 헌법상 형 이 확정되기 전까지 미결수용자는 원칙적으로 기본적 인권이 보 장되고 ‘무죄추정의 원칙’이 적용된다. 그리고 미결수용자에게는 구금 동안 자신의 무죄를 입증하거나 재판 및 수사를 받을 준비를 하는 것이 가장 우선되는 과제이다. 이러한 관점에서 본 연구는 미결수용자의 방어권과 관련한 국제기준을 알아보고 국내 상 황과 비교하고자 미결수로 구치소에 구금되어 있던 7명의 참가자를 대상으로 인터뷰를 진행하였다. 인터뷰의 질적인 분석 결과, 미결수용자가 법적인 방어권을 보장받기에는 많은 어려움과 제한점이 있음을 발견하였다. 구체적인 결과와 함께 개선 방안에 대해 논의하였다.
