Recently, due to a series of crime reports of mentally disabled people, it is true that the focus is on the punishment for criminals with mental disorders rather than on understanding mental disorders and mental disorder crimes. This study examined the actual status of crimes of the mentally disabled, the treatment in the criminal justice system, and the treatment in the mental health system. Within the criminal justice system, care and custody system, treatment order system, treatment consignment system, and after‐care system are implemented, and in the mental health system, mandatory hospitalization and outpatient treatment orders are in operation. To prevent mental disorder crimes in advance and to increase the legal effect, the two systems must be cooperative, and to treat criminals with mental disorders and help them return to society, it is necessary to prepare various treatment systems, and establish mental health systems and mental health services to intervene in stages centering around the community.

최근 정신장애인의 범죄보도가 부각되면서 정신장애와 정신장애범죄에 대한 이해와 예방보다는 정신장애범죄인에 대한 처벌에 관심이 모아지는 상황에 서 정신장애인의 실질적인 범죄현황과 형사사법체계 내에서의 치료처우와 정신건강의료체계에서의 치료처우에 대해서 살펴보았다. 형사사법체계 내에 서는 치료감호제도, 치료명령제도, 치료위탁제도, 사후관리제도가 시행되고 있으며 정신건강의료제계에서는 강제입원과 외래치료명령제도가 운영되고 있다. 정신장애범죄를 사전에 예방하고 법적효과를 높이기 위해서는 두 체계 가 협력적으로 운영되어야 하며, 정신장애범죄인을 치료하고 이들이 다시 사 회로 복귀할 수 있도록 다양한 처우제도가 마련되고, 단계별로 개입할 수 있 도록 정신건강제도 및 정신건강서비스를 지역사회를 중심으로 구축해야 한다.
