The purpose of this study is to contemplate the meaning of ‘equality’ as a citizen right through the US Supreme Court case analysis. The Supreme Court’s controversial jurisprudence about the ‘equality’ principle contains a history of US political conflicts and resolutions. The principle of ‘equality’ in American society is protected by the Fourteenth Amendment, but the precedents of the Supreme Court are changing in the course of history. Therefore, this study analyzed the process of changing the history-social meaning of ‘equality’ principle by selecting cases related to ‘equality’ principle. As a result of the analysis, the standard of judicial examination related to the ‘equality’ principle of the Fourteenth Amendment is mainly based on the confrontation between ‘judicial restraint’ and ‘judicial activism’. Specifically, the principle of ‘equality’ is applied only to ‘minimum rationality’ principle in addition to ‘separate but equal’ principle through ‘rational basis review’ in reality. After World War II, however, the pattern of the Supreme Court’s ruling changes, and based on the ‘strict scrutiny review’ there is a tendency to ‘judicial activism’ in which the principle of ‘separate but equal’ is considered unconstitutional. This tendency means ‘substantive equality of a weak sense’, and the Supreme Court goes on to pursue ‘substantive equality of a strong sense’ that emphasizes human rights through an active constitutional interpretation. The above process shows that the progressive and the conservative camps are in general conflict and coordination and that they are expanding the principle of ‘equality’. On the one hand, it seems that the issue of reverse discrimination today appears to be constraining it based on the ‘intermediate scrutiny review’ through the ‘freedom’ principle of the First Amendment in accordance with the context.

본 연구는 미국 연방대법원 판례를 분석하여 시민권으로서 ‘평등’ 원리의 의미 변화를 고찰하는 데 목적이 있다. ‘평등’ 원리를 둘러싸고 치열하게 다루어진 연방대법원의 법리 논쟁에는 수정헌법 14조 를 둘러싼 정치적 갈등과 해결의 진행과정이 담겨있다. 이에 ‘평등’ 원리와 관련된 사건을 선별하여 역 사-사회적인 의미의 변화과정을 분석하였다. 분석 결과, 수정헌법 14조의 ‘평등’ 원리와 관련된 사법심 사 기준은 크게 ‘사법 소극주의’와 ‘사법 적극주의’의 대립을 기본 토대로 삼고 있다. 구체적으로 보면, ‘평등’ 원리는 현실에서 ‘합리적 심사기준’을 통해 ‘분리주의적 평등’ 원칙과 함께 ‘최소 합리성’의 기준 만이 적용되었다. 그러나 2차 세계대전 이후 연방대법원의 판결 양상이 달라지는데, ‘엄격 심사기준’을 바탕으로 ‘분리주의적 평등’ 원칙 자체를 위헌으로 판단하는 등 사법 적극주의 경향이 나타나기 시작 한다. 이러한 경향은 ‘소극적 의미의 실질적 평등’을 의미하는 것으로, 이후 연방대법원은 적극적 헌법 해석을 통해 인권을 강조하는 ‘적극적 의미의 실질적 평등’을 추구하는 경향으로 나아간다. 이상의 과 정은 진보 진영과 보수 진영이 전반적으로 갈등하고 조정하는 가운데 ‘평등’ 원리를 확대하고 있음을 보여준다. 그러나 한편으로 ‘평등’ 원리는 오늘날 역차별 문제가 제기되면서, 상황적 맥락에 따른 ‘중간 심사기준’을 통해 수정헌법 1조의 ‘자유’ 원리와의 조화를 시도하고 있다.
