Recently, our society has undergone many social changes through the development of the Internet industry. This development of the Internet industry is also having a huge impact on the way sex trafficking. To prevent the harmful effects of online prostitution at a time when the nature of online prostitution is increasing, the U.S. enacted FOSTA to impose civil and criminal responsibilities on online platform owners that are allowed to sell sex or to post advertisements. The study was conducted with the aim of first reviewing the main contents of the FOSTA and the pros and cons of it in the U.S. and then trying to draw up suggestions on the online anti-prostitution policy by revealing problems through comparison with our legal system. On March 21, 2018, The U.S. Senate Passed “FOSTA,” otherwise known as the “Allow States and Victims to Fight Online Sex Trafficking Act.” H.R. 1865, 115th Cong. (2018). FOSTA creates an exception to Section 230 of the Communications Decency Act, which provides websites immunity for content posted by third parties. FOSTA expands existing federal criminal law to target online platforms where users discuss sex work and related topics. Platform owners can be prosecuted under the expanded law even in cases where they didn’t know that people were using those platforms to engage in sex work, and even in situations where there is no indication of coerced sex trafficking of adults or minors. FOSTA opens online platforms to new criminal and civil liability for hosting content about sex work at both the federal and state levels. And an online platform can be prosecuted under federal and state law or held civilly liable for hosting content created before FOSTA passed. Based on these findings, the study made policy suggestions for legislation to prevent online prostitution in the future.

최근 우리 사회는 인터넷 산업의 발달을 통해 많은 사회적 변화를 겪고 있다. 이러한 인터 넷 산업의 발달은 성매매의 행위 방식에도 큰 영향을 미치고 있다. 온라인이 가지는 비대면성 등의 특징에 기인하여 온라인 성매매가 증가하고 있는 시점에서 이 폐해를 방지하기 위해 미 국은 FOSTA를 제정하여 성매매를 알선하거나 광고 게재를 허용하는 온라인 플랫폼 관리자 에게 민⋅형사상 책임을 부여하도록 하였다. 이 연구는 미국의 온라인 성매매 방지법의 주요 내용과 그에 대한 미국 내의 찬반론을 먼 저 검토한 후 관련 내용을 바탕으로 우리법제와의 비교를 통해서 어떠한 문제점이 있는지를 밝혀 온라인 성매매 방지 정책과 관련한 시사점을 도출하고자 하는 목적에서 수행되었다. 2018년 3월 21일, 미국 상원은 “FOSTA”로 알려진 온라인 성매매 방지법을 통과시켰다. FOSTA는 제3자가 게시한 콘텐츠에 대해 웹사이트에 면책특권을 제공하는 통신품위법 230조 에 예외를 두고 있는 법이다. FOSTA는 사용자가 성매매 및 관련 주제를 논의하는 온라인 플 랫폼을 대상으로 기존 연방 형법을 확장하고 있다. 플랫폼 소유자는 제3자가 성매매 광고를 게시함에 고의가 없는 경우뿐만 아니라 성인이나 미성년자의 강제적인 성매매를 나타내는 징 후가 없는 경우에도 확대된 법에 따라 기소될 수 있다. 또한 연방 및 주 차원에서 성 관련 콘 텐츠 게시에 대해 온라인 플랫폼의 새로운 형사 및 민사 책임을 발생시키고 있으며, 소급효를 인정하여 법 시행 전에 게시된 콘텐츠에 대하여 연방 및 주법에 따라 기소되거나 민사 책임을 질 수 있도록 하고 있다. 이 연구에서는 이러한 연구결과에 근거하여 향후 온라인 성매매 방 지를 위한 입법을 위한 정책적 제언을 하였다.
