In the 19th presidential election, President Moon Jae-in expressed his willingness to expand the government's education budget and public participation through education pledges. In other words, it is to strengthen the nation's responsibility for education and to collect the opinions of the people. However, there are still many aspects that cannot be considered as fully reflecting the will of the government. The debate on the Local education autonomy system has been continued until now, but it is hard to find faithfulness to the basic principles of the Constitution. Therefore, this study first summarizes the local educational autonomy system in detail and approaches the key issues of local educational autonomy. In addition, the emphasis was placed on identifying the characteristics of local educational autonomy in Japan and the United States. In particular, it would be most important to set the direction of Korea's Local education autonomy system based on the facts of Japan and the United States.

19대 대선에서 문재인 대통령은 교육공약을 통해 정부의 교육 예산 확대와 국민의 참 여 기회 확대 등을 통하여 국가의 교육에 대한 책임을 강화하고 국민의 의견을 최대 수 렴하고자 함을 밝힌 바 있다. 그럼에 불구하고 변화를 시도한 적은 있으나, 이렇다 할만 한 현 정부의 의지가 충분히 반영된 것이라고 보기에는 힘든 측면이 많다. 지금까지 지 방교육자치제도에 대한 논의는 끊임없이 이어져 왔으나 주민 중심의 의견이 반영되고 교 육이라는 특성을 감안하며 헌법상 기본원리에 충실한 모습은 찾기가 힘들다. 이에 본 연구에서는 먼저 지방교육자치제도의 이념과 기본원리에 대해서 구체적으로 정리해보고, 지방교육자치의 핵심적인 주요 사항에 대해 접근해봄과 동시에 일본, 미국 등 해외의 지방교육자치제도에서 나타나는 시사점을 파악하는 것을 주된 목표로 진행했 다. 특히 일본과 미국의 사례에서 나타나는 시사점을 근거로 우리나라 지방교육자치제도 의 나아가야 할 방향을 설정해 보는 것이 가장 중요할 것이다.
