This dissertation aims to explore the experience of a middle school student who was a participant of a special class as a punishment for the violation of teacher’s right. This study intends to find out the essence of participant’s experience of violating teacher’s right in the context of his general life. The issue of the loss of teacher’s prestige has been discussed for a long time and the efforts of education institutions, schools and teachers to fix it have turned out nominal. Thus, student’s right-focused system has attracted criticism that it caused severe violation of educator’s right in return. The significance of this inquiry is that it aims to explore the essence of participant experience of violation in the perspective of the fact that a hasty alternative could worsen the complication. Narrative inquiry is based on the viewpoint that life is a set of storied experience. It is an effective inquiry method to delve into the core and meanings of participant’s experience. This research pursued overall understanding of it by locating participant in a three-dimensional narrative inquiry space which is place, temporality and sociality. This study is a primary research for further researches to establish an effectual education system to protect the rights of both students and educators.

본 연구는 교권침해 사유로 특별교육에 의뢰되었던 중학생의 이야기를 통해 연구참여자 의 전체적인 삶의 맥락 속에서 교권침해 경험이 무엇인지 탐색하고자 하였다. 오랫동안 회 자된 교권실추를 회복하기 위해 교육기관과 학교, 교사들의 노력이 이어졌지만 교권침해는 오히려 증가하고 있다. 교권침해 문제는 학생인권을 우선시했던 기존 제도에 대한 비판으로 이어져 교권 보호를 위한 법적 제도 마련을 요구하는 목소리가 높아지고 있다. 그러나 문제 의 본질에 대한 충분한 고찰 없이 시행된 제도들은 오히려 문제를 악화시킬 수 있다. 이에 교권을 침해한 중학생의 이야기를 통해 교권침해 문제의 핵심을 알아보고자 한다. 내러티브 탐구 방법은 인간의 삶이 이야기화 된 경험의 집합이라는 관점으로 연구참여자의 내러티브 를 통해 경험의 본질과 의미를 탐색하는데 효과적인 연구 방법이다. 본 연구는 연구참여자 를 내러티브의 3차원적 지점에 위치시켜 다양한 물리적 공간과 시간적 연속선상 속에서 개 인적이면서 동시에 사회적인 연구참여자의 경험에 대한 총체적인 이해를 추구하였다. 본 연 구는 보편화되고 있는 교권침해 문제에 대한 보다 근본적인 해결책을 마련하기 위한 기초 자료이다. 이를 바탕으로 다양한 연구들이 이어지고, 실효성 있는 제도와 체계적인 프로그램 이 구축되어 학교교육의 정상화가 속히 이루어질 수 있기를 기대한다.
