Therapeutic Justice is a combination of therapeutic jurisprudence and a problem-solving court. Therapeutic jurisprudence has been developed as an interdisciplinary examination of the law’s potential as a therapeutic agent. It suggests that the positive and negative effects of law must be studied with the tolls of the behavioral science and that law must be reformd to facilitate achievement of its therapeutic consequences and to minimize its anti-therapeutic ones. In the USA began therapeutic Justice in the realm of the Public Health Act, but it is also explained that it applies to the criminal law. Whether any system in criminal law has realized the goal of therapeutic justice can be judged based on the its function, and the introduction of a problem-solving court in Korea to realize therapeutic jurisprudence also seems necessary in certain areas, such as the Drug Court and the Mental Health Court. In criminal justice, however, it is necessary to examine which offender needs to be ‘treated’ and whether the treatment is possible without compromising other principles of criminal justice. In that case, therapeutic justice is expected to play a very limited role in our criminal justice.

치료사법의 기본구성은 치료지향적 법이론과 문제해결형 법원으로, 이러한 기본구성에 형사사법의 각 단계에서 다양한 치료지향적 프로그램과 제도가 변용, 확장되어 전체로 서의 치료사법모델 내지 치료지향적 형사정책을 이룬다. 치료지향적 법이론의 경험적 관점은 법은 그 자체로서 치료자일 수 있다는 것이며, 규범적 관점은 법체계가 치료적 작용에 보다 효과적으로 기여할 수 있도록 구성되어야 한다는 것이다. 어떠한 제도가 이러한 치료사법의 목표를 실현시켰는지는 치료사법의 기능에 근거해 판단할 수 있으며, 치료지향적 법이론을 실현하기 위한 문제해결법원의 도입도 약물법 원과 정신건강법원 등 특정한 영역에서는 필요하다고 보인다. 그런데 형사사법에서 치 료사법을 실현하기 위해서는 어느 가해자에게 어떤 치료가 필요한지, 그리고 그 치료가 형사사법의 다른 원칙을 훼손하지 않으면서도 가능한지를 검토해야 한다.
