In the recent, the inventive step of use invention for pharmaceuticals is often becoming the big issue. Use invention for pharmaceuticals is classified into two types, i.e., a case in which a new use to a known pharmaceutical is discovered, and other case in which the medicinal effect of the pharmaceutical is more remarkable im compared with precedent pharmaceuticals. So far the issue on the patentability of use invention for pharmaceuticals has mainly focused on whether or not the use invention has met description requirements, novelty and inventive step. The Supreme Court has recognized both difficulties of composition of the invention and remarkability of its effect as important factors in judging the inventive step, and also recognized the exclusion of hide-sight and commercial success as additional factors for judgement of the inventive step. This Supreme Court case is as to inventive step of use invention for pharmaceutical. In particular, this case decides on how some precedent inventions in which teaching away is involved are applied to judgment of inventive step of use invention for pharmaceuticals. This study inquires into main issues of the case where inventive step of use invention for pharmaceuticals is dealt.

최근 의약분야에서는 의약용도에 관한 발명의 진보성에 관한 쟁점이 자주 발생하고 있다. 의약용도발명의 경우 공지된 의약물질에 새로운 용도를 발견한 경우와 이 의약물질의 약리효과가 선행 의약물질에 비해 현저한지 여부를 가지고 특허성을 판단한다. 그동안 의약용도발명의 특허성에 관한 쟁점은 주로 명세서 기재요건 불비, 신규성 및 진보성이었다. 우리나라 법원은 발명의 진보성 판단에 있어서구성의 곤란성 및 효과의 현저성을 중요한 판단요소로 인식하면서, 사후적 고찰 배제, 상업적 성공 등을 부가적인 진보성 판단요소로 고려한다. 본 대상판결은 의약용도발명의 진보성이 쟁점이 된 사안이다. 특히 다수의 선행기술에 해당 특허발명과 관련된 부정적 교시가있을 때 이러한 선행기술을 진보성 판단에 어떻게 적용해야 하는지와 관련한 분쟁이 발생하였을 때 어떠한 판단기준에 의해 판단하는지를 설시하고 있는 판결로서 의미를 가진다. 본 연구에서는 의약용도발명의 진보성 판단에 관한 대상판결의 주요 쟁점을 고찰한다.
