지난 200여 년 동안 발전해온 현대 민주주의와 지방자치 발달을 위해 적극적으로 참여하는 시 민이 필요하다는 것이 하나의 상식으로서 존재하고 있었음에도 불구하고 지금의 민주주의는 대의 민주제의 위기를 넘어 참여 민주주의의 위기라고 언급할 수 있을 정도로 참여층의 과두제화와 극 단적 지역이기주의의, 참여 무관심 층의 증가가 두드러지고 있는 실정이다. 따라서 본 논문은 자치의 근본인 자유주의와 공동체주의를 논리적으로 재탐색해보자는 데에서 출발했다. 우리가 지방자치를 이기적 지방자치가 아닌 자치공동체를 지향한다고 한다면 ‘자유방임 적’ 자치이냐 혹은 ‘공동체주의적’ 자치이냐 라는 문제에서 명백히 후자를 강조해야 한다는 것이다. 그러나 우리의 현실을 보면 지방자치가 이기적인(selfish)것보다는 공동체 정신을 강조하면서 지방 각자의 고유성을 찾아가는 개별주의(individualism)로 나아가는 것이 합리적임에도 불구하고 그렇지 못하다. 그 원인이 어디에 있는 지에 대한 의문을 풀기 위해 자치와 공동체주의에 대한 이론적 논 거와 한국적 상황에서 자치공동체주의에 기반을 둔 지방자치 실천가능성을 모색하고자 하였다. 결론적으로 지역사회에서의 ‘공공의 선’을 만드는 공동체 주의가 우선시되기 위해서는 대의제를 보완하기 위한 SNS등의 직접민주주의 강조에만 있지 않고 읍면동 주민자치위원들의 선출방식을 시민배심원제도와 같은 방식을 주장하고 있다.
